<br />TRUSTEE'S DEED
<br />
<br />This instnnnent, made this 2nd day of March, 2007, between Eric H. Lindquist, a member of
<br />the Nebraska State Bar Association, Successor Trustee, hereinafter called "Grantor", pursuant to a
<br />power of sale contained in that certain Deed of Trust recorded on July 25, 2005 as Instnnnent No.
<br />0200507080 in the office of the Register of Deeds of Hall County, Nebraska, and Larson
<br />Construction, Inc., hereinafter called "Grantee."
<br />
<br />WHEREAS, on October 27,2006, Grantor, executed a Notice of Default pursuant to which
<br />notice was given to David W. Marienau and Sharon L. Marienau, husband and wife, Trustors, under
<br />that certain Deed of Trust recorded on July 25, 2005 as Instrument No. 0200507080 in the office of
<br />the Register of Deeds of Hall County, Nebraska, covering that certain premises described as:
<br />
<br />THE NORTH 44 FEET OF LOT 2, IN BLOCK 21, IN SCARFF'S ADDITION TO
<br />WEST LAWN, IN THE CITY OF GRAND ISLAND, HALL COUNTY,
<br />NEBRASKA, AND A TRACT OF LAND LYING ADJACENT THERETO AND
<br />BEING A PART OF WHAT WAS FORMERLY WEST 17TH STREET IN THE
<br />CITY OF GRAND ISLAND, NEBRASKA AS V ACA TED BY SAID CITY BY
<br />ORDINANCE NUMBER 3993 DATED MAY 15TH, 1963, AND MORE
<br />PARTICULARLY DESCRIBED AS FOLLOWS, TO WIT: BEGINNING AT THE
<br />NORTHWEST CORNER OF LOT 2, IN BLOCK 21, IN SCARFF'S ADDITION TO
<br />WEST LAWN, IN THE CITY OF GRAND ISLAND, NEBRASKA; RUNNING
<br />THENCE EAST ALONG AND UPON THE NORTH LINE OF SAID LOT 2 TO THE
<br />NORTHEAST CORNER OF SAID LOT 2; THENCE RUNNING NORTHERLY ON
<br />A PROLONGATION OF THE EAST LINE OF SAID LOT 2, FOR A DISTANCE OF
<br />14 FEET; THENCE RUNNING WEST PARALLEL WITH THE NORTH LINE OF
<br />SAID LOT 2, TO A POINT ON A PROLONGATION OF THE WEST LINE OF
<br />SAID LOT 2; THENCE RUNNING SOUTH ON A PROLONGA nON OF THE
<br />WEST LINE OF SAID LOT 2, FOR A DISTANCE OF 14 FEET TO THE
<br />NORTHWEST CORNER OF SAID LOT 2, BEING THE POINT OF BEGINNING,
<br />
<br />that a breach of an obligation for which the trust property was conveyed had occurred, and setting
<br />forth the nature of such breach and of his election to sell or cause to be sold such property to satisfy
<br />the obligation. Said Notice of Default was filed for record in the Office of the Register of Deeds of
<br />Hall County, Nebraska, on October 30, 2006, as Instrument No. 0200609656.
<br />
<br />A copy of such Notice of Default was thereafter mailed to all parties entitled to notice
<br />pursuant to said Deed of Trust and in compliance with Section 76-1008 R.R.S. Nebraska.
<br />
<br />Subsequent thereto, beginning on January 19, 2007, Grantor caused to be published in The
<br />Grand Island Independent, a newspaper having a general circulation in Hall County, Nebraska, a
<br />Notice of Trustee's Sale setting forth a description of the property to be sold and stating that the
<br />described property would be sold at public auction to the highest bidder for cash or certified or
<br />cashier's check, at the lower level lobby of the Hall County Courthouse, 1st & Locust Street, Grand
<br />Island, Hall County, Nebraska at 2:00 p.m. on March 1,2007. Publication of such notice was made
<br />for five consecutive weeks on January 19, 2007, January 26, 2007, February 2, 2007, February 9,
<br />2007 and February 16,2007, the last publication being at least ten (10) days but not more than thirty
<br />(30) days prior to the date of sale.
<br />
<br />A copy of such notice of the time and place of sale was thereafter mailed to all parties
<br />entitled to notice pursuant to said Deed of Trust and in compliance with Section 76-1008
<br />R.R.S. Nebraska.
