<br />- - 7 This instrument, made this 13th day of July, 2006, between Eric H. Lindquist, a member of
<br />the Nebraska State Bar Association, Successor Trustee, hereinafter called "Grantor", pursuant to a
<br />power of sale contained in that certain Deed of Trust recorded on March 31, 2004 as Instrument No.
<br />0200403113 in the office of the Register of Deeds of Hall County, Nebraska, and the Secretary of
<br />the Department of Housing and Urban Development, hereinafter called "Grantee."
<br />
<br />WHEREAS, on April 19,2006, Eric H. Lindquist, as Successor Trustee, executed a Notice
<br />of Default pursuant to which notice was given to Benjamin Vera Morales, a married person,
<br />Trustor, under that certain Deed of Trust recorded on March 31, 2004 as Instrument No.
<br />0200403113 in the office of the Register of Deeds of Hall County, Nebraska, covering that certain
<br />premises described as:
<br />
<br />THE NORTH FIFTY EIGHT AND THREE TENTHS (58.3) FEET OF THE
<br />WEST ONE HALF (Wil2) OF LOT THREE (3), OF VANTINE'S
<br />SUBDIVISION, LOCATED ON A PART OF THE NORTHWEST QUARTER
<br />(NWl/4) OF SECTION TWENTY-TWO (22), IN TOWNSHIP ELEVEN (11)
<br />NORTH, RANGE NINE (9) WEST OF THE 6TH P.M., HALL COUNTY,
<br />NEBRASKA,
<br />
<br />that a breach of an obligation for which the trust property was conveyed had occurred, and setting
<br />forth the nature of such breach and of his election to sell or cause to be sold such property to satisfy
<br />the obligation. Said Notice of Default was filed for record in the Office of the Register of Deeds of
<br />Hall County, Nebraska, on April 21, 2006, as Instrument No. 0200603573.
<br />
<br />A copy of such Notice of Default was thereafter mailed to all parties entitled to notice
<br />pursuant to said Deed of Trust and in compliance with Section 76-1008 RRS. Nebraska.
<br />
<br />Subsequent thereto, beginning on May 26, 2006, Grantor caused to be published in The
<br />Grand Island Independent, a newspaper having a general circulation in Hall County, Nebraska, a
<br />Notice of Trustee's Sale setting forth a description of the property to be sold and stating that the
<br />described property would be sold at public auction to the highest bidder for cash or certified or
<br />cashier's check, at the lower level lobby of the Hall County Courthouse, 1st & Locust Street, Grand
<br />Island, Hall County, Nebraska at 2:00 PM on July 11, 2006. Publication of such notice was made
<br />for five consecutive weeks on May 26, 2006, June 2, 2006, June 9, 2006, June 16, 2006 and June
<br />23, 2006, the last publication being at least ten (10) days but not more than thirty (30) days prior to
<br />the date of sale.
<br />
<br />A copy of such notice of the time and place of sale was thereafter mailed to all parties
<br />entitled to notice pursuant to said Deed of Trust and in compliance with Section 76-1008
<br />R.RS. Nebraska.
<br />
<br />Pursuant to said Notice of Trustee's Sale, John B. McDermott, attorney for Eric H.
<br />Lindquist, Successor Trustee, did at the time and place mentioned in said Notice of Trustee's Sale,
<br />offer said property for sale at public auction, and did sell the same to Chase Home Finance LLC for
<br />the sum of$84,742.54, it being the highest bidder therefor. Chase Home Finance LLC has assigned
<br />all of its right, title and interest in such bid to Grantee.
