<br />L <br /> <br />200702249 <br />CONSENT TO CONDITIONAL ASSIGNMENT OF LEASE <br />AS SECURITY <br /> <br />The undersigned CINDY BRADDY, hereinafter referred to as "Lessor", hereby <br />consents to the conditional assignment to HOME FEDERAL SAVINGS AND LOAN <br />ASSOCIATION OF GRAND ISLAND, hereinafter referred to as "Secured Party", by <br />WENDGRAND, LLC, a Nebraska limited liability company, hereinafter referred to as <br />"Borrower", of its interest as Lessee in respect to a Lease currently in effect through May <br />31, 2012, together with all renewals and extensions thereof, in respect to that real estate <br />described as: <br /> <br />A tract of land located in the Southeast Quarter of the Southeast Quarter <br />(SE1/4SEl/4) of Section Twenty-One (21), Township Eleven (11) North, <br />Range Nine (9) West of the 6th P.M., in Hall County, Nebraska, more <br />particularly described as follows: <br /> <br />Beginning at a point Seven Hundred Seven and Five-Tenths (707.5) feet <br />South of the Southeast corner of Pleasant Home Subdivision, said point <br />being Thirty-Three (33.0) feet West of the East line of Section Twenty- <br />Onc (21); thence W csterly parallel to the South line of said Pleasant Home <br />Subdivision a distance of Two Hundred Sixty-One (261.0) feet; thence <br />Southerly parallel to the East line of said Section Twenty-One (21), a <br />distance of One Hundred Thirty-Four (134.0) feet; thence Easterly parallel <br />to the South line of said Pleasant Home Subdivision, a distance of Two <br />Hundred Sixty-One (261.0) feet; thence Northerly parallel to the East line <br />of said Section Twenty-One (21), a distance of One Hundred Thirty-Four <br />(134.0) feet, to the place of beginning, EXCEPTING a certain tract to the <br />City of Grand Island more particularly described in Warranty Deed <br />recorded in Book 179, Page 238 and EXCEPTING a certain tract to the <br />City of Grand Island more particularly described in Warranty Deed <br />recorded as Document No. 200316253. <br /> <br />Such Consent to Conditional Assignment is given by Lessor in respect to a <br />Conditional Assignment of Lease given by Borrower to Secured Party as a portion of thc <br />security for payment of indebtedness owing to Secured Party by Borrower that is further <br />secured-by-a Deed of Trust and Financing Statement relating -tothe-improvements located <br />upon such real estate. This consent is further subject to the Agreement of the Secured <br />Party to be bound by all of the provisions of such Lease in the event it comes into <br />possession of the leasehold premises by reason of default by the Borrower in <br />performance of its obligations with Secured Party. <br /> <br />Lessor acknowledges that she is aware and consents to the fact that such <br />Conditional Assignment by Borrower in favor of Secured Party shall remain effective <br />until the indebtedness owing to Secured Party shall be paid i fOAl. <br /> <br />
