<br />whole of the demised premises at the date of condemnation. If all of the demised <br /> <br />200702101 <br /> <br />premises be taken or condemned. or 50 much thereof that the use by LESSEE shall <br /> <br />be substantially impaired (and in this regard the parties acknowledge the parking <br /> <br />area to be of great importance to the business of LESSEE}, the LESSEE may there- <br />,- <br /> <br />upon terminate this Lease. All compensation awarded l)-pon any such condemnation <br /> <br />c.rtaking shall go to the LESSOR and the LESSEE as provided by law; but LESSEE <br /> <br />shall in any event be entitled to the award of an amount equal to the value of the <br /> <br />building, fixtures and equipment, and improvements at such time. <br /> <br />ARTICLE XV _ SUBLETTING AND ASSIGNEM~NT - JUDICIAL PROCEEDINGS <br /> <br />15.1 'Teither this Lease nor any interest therein shall be assignable <br /> <br />by action at law, inciuding bankruptcy, either involuntary or voluntary, and no <br /> <br />trustee, sheriff. creditor, purchaser at any judicial sale, officer of any court, or <br /> <br />receiver shall acquire any right under this Lease or any right to the possession or <br /> <br />use of the Leased Premises or any part thereof without the prior written consent of <br /> <br />LESSOR. Any violation of the above terms of this paragraph may at the option of <br /> <br />the LESSOR be deemed a material breach of this Lease. <br /> <br />ARTICLE:h'VI -DEFAULT - REMEDIES <br /> <br />16.1 If l.ESSEE shall default in the due observance and performance <br /> <br />of any covenant or agreement contained herein, LESSEE shall have sixty (60) days <br /> <br />from the date of written notice thereof within which to cure said default. <br /> <br />16.2 Right to Re-Enter: <br /> <br />In the event of any failure of the LESSEE <br /> <br />to pay any rental due hereunder within thirty (30) days from when the same shall be <br /> <br />due or any failure to perform any other of the terms, conditions or covenants of <br /> <br />thIs Lease to be observed or performed by the LESSEE for more than sixty (60) days <br /> <br />after written notice of such default shall have been mailed to LESSEE, as provided <br /> <br />herein, or if LESSEE shall become bankrupt or insolvent, or file any debtor pro- <br /> <br />ceedings, or take or have taken against LESSEE in any court pursuant to any statute <br /> <br />either of the United States or of any state a petition in' bankruptcy or insolvency <br /> <br />or' for reorganIzation or for the appointment of a receiver or trustee of all or a portion <br /> <br />of LESSEE'S property I or if LESSEE makes an assignment for the benefit of creditors. <br /> <br />-,..._~--~---~ <br /> <br />or petitions for or enters into an arrangement, or if LESSEE shall abandon said <br /> <br />premises, or suffer this Lease to be t<lken under any writ of execution, then LESSOR, <br /> <br />(11\_~~ <br /> <br />-8~ <br /> <br />(fit <br />
