<br />200702031 <br /> <br />AGREEMENT <br /> <br />/' <br />THIS AGREEMENT is made and entered into this / j day of March, 2007, by and <br />between NED J. NELSON and LAURA M. NELSON, husband and wife, hereinafter collectively <br />referred to as "Nelson", and CLEO BEBERNISS and RAMONA BEBERNISS, husband and <br />wife, hereinafter collectively referred to as "Bebemiss". <br /> <br />WITNESSETH: <br /> <br />WHEREAS, Nelson owns the real estate legally described as follows: <br /> <br />Lot One (1), Bebemiss Subdivision, Hall County, Nebraska, <br /> <br />hereinafter referred to as the "subject property". <br /> <br />WHEREAS, Bebemiss owns the GIS grain bin which is located on the subject property, <br /> <br />and <br /> <br />WHEREAS, the parties hereto desire to enter into this Agreement in order to provide a <br />full statement of their respective responsibilities in connection with the GIS grain bin which is <br />located on the subject property. <br /> <br />NOW, THEREFORE, in consideration of the rents reserved herein and of the covenants, <br />terms, conditions, warranties and agreements herein set forth, Nelson and Bebemiss hereby agree <br />as follows: <br /> <br />1. Consent. Nelson agrees to allow the GIS grain bin to remain on the subject <br />property and to allow Bebemiss, and their agents, access to the GIS grain bin upon the terms and <br />conditions provided hereinbelow. <br /> <br />2. Term. The term of this Agreement shall commence upon the execution hereof <br />and shall end upon the death of Cleo Bebemiss. <br /> <br />3. Rent. As consideration for allowing the GIS grain bin to remain on the subject <br />property and for allowing Bebemiss, and their agents, access to the GIS grain bin, Bebemiss <br />agrees to pay to Nelson annual cash rent in the amount of Two Hundred and No/IOO Dollars <br />($200.00). The first payment of such annual cash rent shall be paid upon the execution ofthis <br />Agreement and subsequent payments of such annual cash rent shall be payable on or before <br />March I st of each year during the term of this Agreement. <br /> <br />4. Death of Bebemiss. As additional consideration for allowing the GIS grain bin to <br />remain on the subject property and for allowing Beberniss, and their agents, access to the GIS <br />grain bin, upon the death of Cleo Bebemiss, Beberniss shall transfer, convey and deliver unto <br />Nelson all of Beberniss' right, title and interest in and to the GIS grain bin free and clear of all <br />liens and encumbrances. <br /> <br />5. Maintenance and Repairs. Beberniss hereby agrees to pay all the costs and <br />expenses incurred as a result of the maintenance and repair of the GIS grain bin. Nelson shall <br /> <br />1 <br />
