If all or any part of the Propeny or an interest therein is sold or transferred <br />(or if a beneficial interest in Borrower is sold or transFerred and Borrower is nol a natural person) without Lender's prior written consent. <br />Lender may, at Lender's opllon, declare alllhe sums secured by this Security Instrument to be immediately due and payable. However. this <br />option shall not be exercised by Lender jf exercise is not authorized by Federal law. Lender may waive the exercise of this option if: (a) Borrower <br />cau.ses to be submitted to Lender information required by Lender to evaluate the intended transferee as if a new loan were being made to the <br />transferee; and (b) Lender reasonably determines that lender's security will not be impaired by the loan assumption and that the risk of the <br />breach of any covenant or agreement in this Security Instrument is acceptable to Lender. <br />To me extent penniUed by applicable law. Lender may charge a reasonable fee as a condition to Lender's consent to the loan assumption. <br />Lender may also require the U'ansferee to keep all the promises and agreements made in the Note and in this Security Instrument. <br />u[f Lender exercises such option to accelerate. Lender shall mail Borrower notice of acceleration in accordance with paragraph 14 hereof. <br />Such notice shall provide a period of not less than 30 days from the date the notice is mailed within which Borrower may pay the sums declared <br />due. WAN CHANGES <br />If the loan secured by tbe Security Instrument is subject to a law which sets maximum loan charges. and that law is finally interpreted 50 <br />that the interest or other loan charges coUected or to be collected in connection with the loan exceed permitted limits, then: (I) any such loan <br />charge shall be reduced by the amount necessary to reduce tile charge (0 the permitted limit; and (2) any sums already collected from borrower <br />which exceeded permitted limits will be refunded to Borrower. Lender may choose to make this refund by reducing the principal owed under the <br />Note or by making a direct payment to Borrower.
