BAOAMI, Trustee, upon" Deed of Trust <br />made and entered into on or about May 9, 1985, by and between Larry Lee Coats and <br />Wanda Marlene Coats) Trustors, and Joseph H. Badami, Trustee and First Federal Savings <br />and Loan Association of Lincoln, Beneficiary, of the Register of Deeds office of Hsll <br />County. Nebraska. herein called the GRANTOR, in consideration of Nineteen Thousand Two <br />Hundred and No/100 Dollars (~19,200.00), and other valuable consideration received <br />from Grantee, does hereby grant, bargain, sell, convey and confirm unto FIRST FEDERAL <br />SAVINGS AND LOAN ASSOCIATION OF LINCOLN, a United States Corporation, herein called <br />the GRANTEE, the following described real estate in Hall County, Nebraska: <br /> <br />Lot Eight (8), Block Eighty-four (84), in Wheeler and <br />Bennett's Fourth Addition to the City of Grand Island, <br />Hall County, Nebraska. <br /> <br />TO HAVE AND TO HOLD the above-described premises together with all <br />tenements, hereditaments and apppurtenances thereto belonging unto the Grantee. and to <br />Grantee's successors and ass igns forever. <br /> <br />Grantor does hereby covenant with the Grantee and with the Grantee's <br />successors and assigns: <br /> <br />(1) That Larry Lee Coats and Wanda Marlene Coats. Trustors. failed to pay <br />the Beneficiary payments which were contractually due, and the Grantor, at the request <br />of the BepeficiaryJ elected to declare the entire unpaid principal balance, together <br />with interest thereon, at once immediately due and payable. <br /> <br />(2) That a Notice of Default was filed by Grantor 00 August 1. 1988, in <br />Document No. 88-104180 of the Miscellaneous Records in the Register of Deeds office of <br />Hall County, Nebraska. A copy of the Notice of Default was served upon Larry Lee <br />Costs and Wanda Marlene Coats by certified mail, postage prepaid, on August 3, 1988. <br /> <br />(3) That Trustors, Larry Lee Costs and Wanda Marlene Coats, failed to cure <br />the default referenced in the Notice of Default within 30 days after the service of <br />the Notice of Default. <br /> <br />(4) That a Notice of Trustee's Sale was filed and a copy of the Notice of <br />Trustee's Sale was served upon Larry Lee Coats and Wanda Marlene CoatsJ by certified <br />mail, postage prepaid on September 6, 1988. <br /> <br />(S) Grantor published Notice of Trustee's Sale, to be held on Tuesday, the <br />18th day of October, 1988, at 10 o'clock a.m., at Grand Island, Hall County, Nebraska. <br />which Notice was publiahed in Grand Island Independent, Hall County. Nebraska, once a <br />week for five (5) consecutive weeks, commencing on August 3D, 1988, and ending on <br />September 26, 1988. The last publication on Notice was at least ten (10) daya prior <br />to the Trustee'~ Sale, and said sale was not later than thirty (30) days after the <br />last publication of Notice. <br /> <br />(6) Grantor conducted the sale of the real property at public auction and <br />bas accepted the bid of First Federal Savings and Loan Association of Lincoln in the <br />sum of Nineteen Thousand Two Hundred and No/100 Dollars (~19,200.00), as the highest <br />bid upon said real property. Grantor has complied with the requirements of the <br />above-referenced Deed of Trust and the requirements of Nebraska Statutes, S76-l001 <br />through S76-1018, 1965, in the exercise of the sale of the real property described <br />berein at the Trustee' a Sale held on October 18, 1988. <br /> <br />This Deed shall operate to convey to the Grantee, without right of <br />redemption, the Grantor's title and all right, title, interest and claim of the <br />Trustor, and their successors in interest and of all persons claiming by, through or <br />under it, in and to the above-described real property, including all such right, <br />title, interest and claim ln interest &ubsequent to the execution oi the Deed of <br />Trust. <br /> <br />This Deed is subject to all easements. restrictions or covenants of record, <br />which br'Ultor is not entitled to convey pursuant to Nebraska Statute.
