<br />88- 105731 <br /> <br />OPTION AGREEMENT <br /> <br />N. THEODORA KIRKPA'l'RICK, An. Unremarried Widow, <br />hereinafter referred to as .Owner" in consideration of the <br />purchase of Lot One (1), Kirkpatrick Subdivision, at a <br />purchase pric.e of Fourteen Thousand Five Hundred Dollars <br />($14,500.00), hereby grants to DALE L. SKOW and .sHIRLEY M. <br />SKOW, with rights of survivorship, the exclusive right, <br />option and privilege to purchase, for the sum of Thirteen <br />Thousand Dollars ($13,000.00) the following described real <br />estate: <br /> <br />Lot Two (2), Kirkpatrick Subdivision, to the City <br />of Grand Island, Hall County, NebraSka, <br /> <br />upon the following terms and conditions: <br /> <br />1. This right and privilege to purchase shall expire <br />if not exercised by 12:01 A.M., October 1, 1989. <br /> <br />2. The option provided for in this Agreement shall be <br />exercised by written notice delivered to the OWner <br />personally or by United States certified mail addressed to <br />the Owner as follows: N. Theodora Kirkpatrick, <br /> <br />Huston Co. Agen ts, Box 699. Grand Island, NE 6BB02 <br /> <br />3. In the event of the exercise of the option by <br />either Mr. or Mrs. Skow, closing shall be at such date, time <br />and place as selected by the parties provided that closing <br />shall be no later than 90 days after giving notice of <br />exercise of option. At such closing Owner shall convey <br />marketable fee simple title by warranty deed to Lot Two (2), <br />Kirkpatrick Subdivision to the City of Grand Island, Hall <br />County, Nebraska, to Dale L. Skow and Shirley M. Skow as <br />joint tenants, free and clear of liens and encumbrances. <br />Owner shall pay all real estate taxes to date of closing. if <br />the then current years real estate taxes have not been <br />assessed by closing date, the taxes shall be prorated to <br />date of closing and paid by Owner based upon the most recent <br />years assessment. <br /> <br />4.
