<br />88-105459 <br /> <br />EASEMENT <br /> <br />THIS AGREEMENT is made and entered into this_5;t~, day of <br />October 1988, by and between CLARENCE L. DIERKING ana-IRENE A, <br />DIERKING, husband and wife, hereinafter "Party of the First <br />Part," whether one or more, which expression shall include their <br />respective heirs, successors, and assigns, and LUCILLE A, HARRY, <br />a single person, hereinafter "Party of the Second Part," which <br />expression shall include her heirs, successors, and assigns. <br /> <br />WITNESSETH: <br /> <br />WHEREAS, the Party of the First Part owns and has title to <br />that real estate and real property located in Grand Island, Hall <br />County, Nebraska, described as follows: <br /> <br />Lot One Hundred Ninety Eight (l98), West Lawn, an <br />Addition to the City of Grand Island, -Hall County, <br />Nebraska, located at 1417 North Huston Avenue; and <br /> <br />WHEREAS, the Party of the Second Part owns and has title to <br />that real estate and real property located in Grand Island, Hall <br />County, Nebraska, described as follows: <br /> <br />Lot One Hundred Ninety Nine (199), West Lawn, an <br />Addition to the City of Grand Island, Hall County, <br />Nebraska, located at 1419 North Huston Avenue, and <br /> <br />WHEREAS, located on the real estate owned by Party of the <br />Second Part exists a garage which slightly infringes upon <br />property owned by Party of the First Part, namely an area <br />described as 1 foot in width and 24.1 feet in length, as shown by <br />the plot plan attached hereto and incorporated herein by this <br />reference; and <br /> <br />WHEREAS, the Party of the Second Part desires to have an <br />easement to the real estate owned by Party of the First Part upon <br />which the garage owned by Party of the Second Part sits. <br /> <br />NOW, THEREFORE, it is hereby agreed as follows: <br /> <br />1. The Party of the First Part does hereby grant, assign, <br />and set over to the Party of the Second Part a permanent easement <br />for purposes of maintaining the garage primarily located on real <br />estate owned by Party of the Second Part. <br /> <br />2. Party of the Second Part hereby agrees to hold and save <br />the said Party of the First Part harmless from any and all damage <br />arising from her use of the right, easement, and right of way <br />herein granted and agrees to pay any damage or damages which may <br />arise to the property, premises or rights of the Party of the <br />First Part through Second Party's use, occupation, and possession <br />of the rights herein granted. <br /> <br />TO HAVE AND TO HOLD the said easement, right, and right of <br />way unto the Party of the Second Part, her heirs, successors, and <br />assigns, in perpetuity, said easement to follow the land. <br /> <br />IN WITNESS WHEREOF, the parties have set their <br />hands and seals the day and year first abov. <br /> <br />r~vi/)- ".u-....I"L.L'-Vc <br />Cla~nce L.
