<br />88-105432 <br /> <br />E L E C T R I C ALE A S E MEN T <br /> <br />LYNN AND TOM PARTNERSHIP. a Nebraska Partnership, herein called the <br />Grantor, in consideration of One Dollar ($1.00) ,receipt of which is <br />hereby acknowledged, hereby grants and conveys unto the <br /> <br />CITY OF GRAND ISLAND, NEBRASKA, <br /> <br />a municipal corporation in Hall County, Nebraska, herein called the Grantee. a <br />Jlermanent and perpetual easement and right-of-way to survey, construct, <br />inspect. maintain, repair, replace, extend, remove, and operate thereon, <br />overhead and underground electrical utility lines, cables, poles, anchors, <br />terminals, transformers, surface markers, and other appurtenances connected <br />therewith, in, upon, above, aleng, across, underneath, and' through the <br />Westerly eight (8) feet of Lot One (I), Block Two (2). Colonial Estates Second <br />Subdivision, in the City of Grand Island, Nebraska. This easement containing <br />0.037 acre. more or less, as shown on the plat dated 9/2/88, marked Exhibit <br />"A", attached hereto. and incorporated herein by reference. together 'With the <br />following rights: <br /> <br />Unrestricted ingress and egress to the above described easement for the <br />installation, maintenance, operation. and removal of such overhead and <br />underground electrical utility lines and appurtenances. <br /> <br />Such rights of ingress and egress shall include all rights necessary for <br />the full and complete use. occupation, and enjoyment of the easement herein <br />granted including, but not limited to, the right to excavate and refill <br />ditches and trenches, to remove. clear. and keep clear trees, bushes, hedges, <br />undergrowth, and other obstructions interferin~ with the surveying, <br />construction. inspection, maintenance, repair, replacement, extension, <br />removal. or operation of such overhead and underground electrical utility <br />lines and appurtenances. No structures, buildings, fences. or other <br />obstructions of any kind whatsoever, shall be allowed in, upon, above. along. <br />across. underneath, Dr through the easement herein granted. <br /> <br />The Grantor and the Grantee hereto agree that the Grantor may use the <br />easement area granted for any use permitted by law, that does not interfere <br />with the operation and maintenance of the overhead and underground electrical <br />utility lines and appurtenances constructed therein. <br /> <br />All overhead and underground electrical utility lines, cables, poles. <br />anchors, terminals, transformers, surface markers, and other appurtenances <br />connected therewith, placed in, upon, above. along, across. underneath, and <br />through such easement shall remain the property of the Grantee, and may be <br />removed or replaced at any time. <br /> <br />The Grantor for itself. its heirs, successors, and assigns, hereby <br />covenants that the rights and privileges herein granted shall run with the <br />title to such tract of land, and be binding upon the Grantor, all heirs, <br />successors, and assigns. <br /> <br />Dated <br /> <br />k5- t.-88 <br /> <br />- 1 - <br />
