<br />HALL COUNTY LIVESTOCK IMPROVEMENT ASSOCIATION, a Nebraska corporstion,
<br />herein called the Grantor, in conaideration of One Dollar ($1.00)
<br />receipt of which is hereby acknowledged, hereby grants and conveys unto the
<br />
<br />CITY OF GRAND ISLAND, NEBRASKA,
<br />
<br />a municipal corporation in Hall County, Nebraska, herein called the Grantee, a
<br />permanent and perpetual easement and right-of-way to survey, construct,
<br />inspect, maintain, repair, replace, extend, remove, and operate thereon,
<br />overhead and underground electrical utility lines, cables, poles, anchors,
<br />terminals, transformers, surface markers, and other appurtenances.connected
<br />therewith, in, upon, above, along, across, underneath, and through a tract of
<br />land located in part of the Northwest Quarter of the Southwest Quarter (NW-l/4,
<br />SW-l/4) of Section Twenty Two (22), Township Eleven (11) North, Range Nine (9)
<br />West, of the 6th P.M., Grand Island, Nebraska; the centerline of the sixteen
<br />(16) foot wide easement being more particularly described as follows:
<br />
<br />Beginning at a point on the South line of Fonner Third
<br />Subdivision, said point being eight (8) feet East of the
<br />Northeast corner of Janisch Subdivision; thence Southerly
<br />parallel to the East line of said Janisch Subdivision, a
<br />distance of three hundred twenty eight (328.0) feet; thence
<br />Westerly parallel to the South line of said Janisch
<br />Subdivision, a distance of two hundred sixty five (265.0)
<br />feet; thence Southerly parallel to the East right-of-way
<br />line of Locust Street, a distance of eighty five (85.0)
<br />feet.

<br />The above described tract of land containing 0.25 acre,
<br />more or less, as shown on the plat dated 8/1/88, marked
<br />Exhibit "A", attached hereto, and incorporated herein by
<br />reference,
<br />
<br />together with the following rights:
<br />
<br />Unrestricted ingress and egress to the above described easement for the
<br />installation, maintenance, operation, and removal of such overhead and
<br />underground electrical utilities and appurtenances.
<br />
<br />Such rights of ingress and egress shall include all rights necessary for
<br />the full and complete use, occupation, and enjoyment of the easement herein
<br />granted including, but not limited to, the right to excavate and refill ditches
<br />and trenches, to remove, clear, and keep clear trees, bushes, hedges,
<br />undergrowth, and other obstructions. interfering with the surveying,
<br />construction, inspection, maintenance, repair, replacement, extension, removal,
<br />or operation of such overhead and underground electrical utilities and
<br />appurtenances. No structures, buildings, fences, or other obstructions of any
<br />kind whatsoever, shall be allowed in, upon, above, along, across, underneath,
<br />or through the easement herein granted.

<br />The Grantor and the Grantee hereto agree that the Grantor may use the
<br />easement area granted for any use permitted by law, that does not interfere
<br />with the operation and maintenance of the overhead and underground electrical
<br />utilities and appurtenances constructed therein.
