<br />ROBI!RT K. POLAND and JUDITH K. POLAND, Husband and Wife, herein called the
<br />Grantor, in consideration of One DollaT ($1.00) ,receipt of which is
<br />hereby acknowledged, hereby grants and conveys unto the
<br />
<br />CITY OF GRAND ISLAND, NEBRASKA,

<br />a llIUIlicipal corporation in Ball County, Nebraska, herein called the Grantee, a
<br />permanent and perpetual easement and right-af-way to survey, construct,
<br />inspect. maintain. repair. replace. extend, remove. and operat.e thereon.
<br />overhead and underground electrical utility lines. cables. poles. anchors.
<br />terminals, transformers. surface markers, and other appurtenances connected
<br />therewith, in, upon, above, along, across, underneath, and through a tract of
<br />land located in part of the Northwest Quarter of the Northwest Quarter (NW-l/4,
<br />NW-l/4) of Section Five (5), Township Ten (10) North, Range Nine (9) West, of
<br />the 6th P.M., Hall County, Nebraska; the centerline of the sixteen (16.0) foot
<br />wide easement being more particularly described as follows:

<br />Commencing at the Northwest corner of said Section Five
<br />(5); thence Easterly along the North line of said Section
<br />Five (5), a distance of one hundred thirty one (131.0)
<br />feet; thence deflecting right 89013'31", and running
<br />Southerly a distance of four hundred sixty five and forty-
<br />one hundredths (465.41) feet to the Actual Point Of
<br />Beginning; thence continuing Southerly on the last
<br />described course, a distance of eight hundred fifty four
<br />and twenty-five hundredths (854.25) feet, to a point on the
<br />South line of the Northwest Quarter of the Northwest
<br />Quarter (NW-1/4,NW-1/4) of said Section Five (5).

<br />The above de,-::ribed easement contains 0.355 acre, mare or
<br />less, as 9ho~~ on the plat dated 8/29/88, marked Exhibit
<br />itA". attached hereto, and incoC'?orated herein by reference,

<br />together with "~ following rights:

<br />Unrestricted ingress and t:::!i=cass to the above described easement fot:' the
<br />installation, maintenance, operation, and 1~val of such overhead and
<br />underground electrical utility lines and appurtenanc~.

<br />Such rights of ingre"s and egress shall include all rigi.t,s necessary for
<br />the full and complete use, occupation, and enjoyment of the eaSeD.qnt herein
<br />granted including, but not limited to, the right to excavate and retlll ditches
<br />and trenches, to remove, clear, and keep clear trees, bushes, hedges,
<br />undergrowth, and other obstructions interfering with the surveying,
<br />construction, inspection, maintenance, repair, replacement, Bxtension, removal,
<br />or operation of such overhead and underground electrical utility lines and
<br />appurt........cBS. No structures, buildings, or other obstructions of any kind
<br />whatsoever. shall be allowed in, upon, above, alon8, across, underneath, or
<br />through the Basement herein granted, except for fences as they currently exist.

<br />The Grantor and the Grantee hereto agree thAt the Grantot may use the
<br />eu_t area granted for any uae permitted by law, that does not interfere
<br />with the operation and l118intenance of the overhead and underground electrical
<br />utllity linea and appurtenances constructed therein.
