<br />KNOW ALL MEN BY THESE PRESENT: That JOSEPII II. BADAMI, Trustee, upon a Deed of Trust
<br />made and entered into on or about September 25, 19B4, by and between Dayne M. Reed and
<br />Julie A. Reed, Trustors, and Joseph H. Badami, Trustee and First Federal SlIvings and
<br />Loan Association of Lincoln, Beneficiary, of the Register of Deeds office of Hall
<br />County, Nebraska, herein called the GRANTOR, in consideration of Twenty-nine Thousand
<br />Eight Hundred and No/lOO Dollars ($29,800.00), and otber valuable consideration
<br />received from Grantee, does hereby grant, bargain, sell, convey and confirm unto FIRST
<br />FEDERAL SAVINGS AND LOAN ASSOCIATION OF LINCOLN, a United States Corporation, herein
<br />called the GRANTEE, the following described real estate in Hall County, Nebraska:
<br />
<br />Lot Thirty-five (35), in Sass Second Subdivision, located
<br />in Section 14, Township 11 North, Range 9 West of the
<br />6th P.H., Hall County, Nebraska.
<br />
<br />TO HAVE AND TO HOLD the above-described premises together with all
<br />tenements. hereditaments and apppurtenances thereto belonging unto the Grantee, and to
<br />Grancee I 5 successors and ass igns forever.
<br />
<br />Grantor does hereby covenant with the Grantee and with the Grantee's
<br />successors and assigns:
<br />
<br />(1) That Dayne N. Reed and Julie A. Reed, Trustors, failed to pay the
<br />Beneficiary payments which were contractually due, and the Grantor, at the request of
<br />the Beneficiary, elected to declare the entire unpaid principal balance, together with
<br />interest thereon. at once immediately due and payable.
<br />
<br />(2) That a Notice of Default was filed by Grantor on May 24, 1988 in
<br />Document No. 88-102657 of the Miscellaneous Records in the Register of Deeds office of
<br />Hall County, Nebraska. A copy of the Notice of Default was served upon Dayne M. Reed
<br />and Julie A. Reed by certified mail, postage prepaid, on Nay 26, 1988.
<br />
<br />(3) That Trustors, Dayne N. Reed and Julie A. Reed, failed to cure the
<br />default referenced in the Notice of Default within 30 days after the service of the
<br />Notice of Default.
<br />
<br />(4) Tbat a Notice of Trustee's Sale was filed and a copy of the Notice of
<br />Trustee's Sale was served upon Dayne M. Reed and Julie A. Reed, by certified mail,
<br />postage prepaid on July 8, 19B8.
<br />
<br />(5) Grantor published Notice of Trustee's ~ale, to be held on Wednesday,
<br />the 24th day of August, 1988, at 10 o'clock a.m., at Grand Island, lIal1 County,
<br />Nebraska, which Notice was published in Grand Island Independent, lIall County,
<br />Nebraska, once a week for five (5) consecutive weeks, commencing on July 7, 1988, and
<br />ending on August 4, 1988. The last publication on Notice was at least ten (10) days
<br />prior to the Trustee's Sale, and said sale was not later than thirty (30) days after
<br />tbe last publication of Notice.
<br />
<br />(6) Grantor conducted the sale of the real property at public auction and
<br />has accepted the bid of First Federal Savings and Loan Association of Lincoln in the
<br />sum of Twenty-nine Thousand Eight Huodred and No/lOO Dollars ($29,800.00), as the
<br />highest bid upon said real propert.y. Grantor has complied with the requirements of
<br />the above-referenced Deed of Trust and the requiremenLs of Nebraska Statutes, ~76-1001
<br />through S76-1018, 1965, in the exercise of the sale of the real property described
<br />herein at the Trustee's Sale held on August 24, 1988.
<br />
<br />This Deed sball operate to convey to the Grantee, witbout right of
<br />redemption, the Grantor's title and all right. title, interest and claim of the
<br />Trustor, and their successors in interest and of all persous claiming by, through or
<br />under it, in and t.o the above-described real property. including all such right,
<br />title, interest and claim in interest subsequent to tbe execution of the Deed of
<br />Trust:.

<br />This Deed is subject to all easements, restrictIons or covenants of record.
<br />which Gran~or is not entitled to convey pursuant to Nebraska Statute, ~76-10l0(2),
<br />R.R.S., 1965.
