<br />~8-. 104743 <br /> <br />LJg;;~E ABRI;,!;!1ENT <br /> <br />This License Agreement is made by and between the CITY OF <br />BRAND ISLAND, NEBRASKA, a Municipal Corporation, herein referred <br />to as the "City" and MARK A. PURDIE and JODY L. PURDIE, husband <br />and wife, hereinafter referred to as the "Licensees".. <br /> <br />1. STATEMENT OF PURPOSE. The purpose of this License <br />Agreement is to set forth the terms and conditions under which <br />the Licensees may construct, maintain, repair, and utilize the <br />fol1owino described improvement which will infringe upon real <br />estate owned Dr controlled by the City: <br /> <br />1.4 foot x 18 foot encroachment of garage in alley <br />adjacent to 307 West Ninth Street, Brand Island, <br />Hall County, Nebraska. <br /> <br />2. DESCRIPTION OF LICENSEES' REAL ESTATE. The Licensees <br />own or control the following described real estate adjacent to <br />the City's real estate to which this License Agreement shall apply: <br /> <br />Lot Two (2), Block Four (41, Russel Wheeler's <br />Addition to the C.ty of Grand Island, Hall County, <br />Nltbr.a.ka. <br /> <br />3. LICENSEES' DUTIES AND RISKS. It is understood and <br />agreed th.t the Licensees may construct, maintain, repair and <br />utilize the above described improvement at the Licensees' 501e <br />risk. The Lic.o...s hereby waives any claim for damages against <br />the CIty, its officers, employees, agents and independant <br />contractors for any damage or injury that may result to said <br />improve.ent. If the City, in its sale discretiony determines <br />that any part or all of the improvement must be removed Dr is <br />da.Aged bV the City, its employees, agents, Dr independent <br />contractors working for the City during the course of their <br />..plov..nt or duties with the City, the Licensees agree to assume <br />and pay .JJ costs relating to the replacement or repair of the <br />i ~rDv.....n t . <br /> <br />4. EFFECTIVE DATE. This license agreement shall take <br />effect on the date it is executed by the Mayor of the City of <br />Grand Island as dated below. It shall continue for an indefinite <br />term until such time as it is terminated as provided hereafter. <br /> <br />5. TERMINATION. This License Agreement shall terminate <br />upon one or more of the follDHing occurrences: <br /> <br />a. The service of si~ty days written notice of <br />intention to terminate by any party upon the other party. <br />
