<br />KNOW ALL MEN BY THESE PRESENTS, That, Whereas, In an
<br />action in the District Court of the Eleventh Judicial District of
<br />the State of Nebraska, within and for the County of Hall, wherein
<br />BANCPLUS MORTGAGE CORP., Assignee, is Plaintiff and SYLVAN C.
<br />ROBERTS and MARY ANN ROBERTS, Husband and Wife, SANDHILLS GRAIN,
<br />INC., A Nebraska Corporation, FIVE POINTS BANK, a Nebraska
<br />Corporation SHONA MAE ROBERTS, SHAYLLA A. ROBERTS, JAKE ROBERTS
<br />and GWYER GRIMMINGER are Defendants, at the January Term, A.D.
<br />1988, of said Court, a decree WaS rendered finding that there is
<br />due and owing to BANCPLUS MORTGAGE CORP. the sum of TWENTY SIX
<br />THOUSAND TWENTY EIGHT DOLLARS AND TWELVE CENTS ($26,028.12)
<br />together with interest thereon from the 1st day of October, 1986,
<br />at the rate of thirteen percent (13\) per annum, and is a first
<br />lien, and costs of suit taxed at THREE HUNDRED NINETY SIX DOLLARS
<br />AND NINETY THREE CENTS ($396.93), and the accruing costs, and,
<br />whereas, it was then and there further ordered in the said action
<br />that in default of the payment of the sum so found due by the
<br />said Defendants that JOHN A. WOLF, the appointed Master
<br />Commissioner, should cause the lands and tenements hereinafter
<br />described to be advertised and sold according to law to pay the
<br />same, and, whereas, default having been made therein, the said
<br />JOHN A. WOLF, Master Commissioner, under and by virtue of the
<br />said decree and the order of sale to him duly directed, did on
<br />the 14th day of June A. D., 1988 at the lower lobby of the
<br />courthouse in the City of Grand Island in said County of Hall,
<br />having first given due and legal notice of the time and place of
<br />said sale once per week for four consecutive weeks prior thereto
<br />in the Grand Island Independent, a newspaper printed and in
<br />general circulation in said County of Hall, sell said premises at
<br />public auction to BANCPLUS MORTGAGE CORP. for the sum of THIRTY
<br />THREE THOUSAND DOLLARS ($33,000.00), which sale was afterward at
<br />the January Term of said court, A,D., 1988, examined and
