<br />88-104351 <br /> <br />AFFIDAVIT <br /> <br /> <br />COMES NOW Judith L. Wiegert, being sworn upon oath deposes <br /> <br />and states as follows: <br /> <br />1. That your affiant is the President of Mid-Continent <br /> <br /> <br />Enterprises, Inc., a Nebraska Corporation and has been President <br /> <br /> <br />of said company at all times relevant hereto. <br /> <br />2. That pursuant to an authorization of the Board of <br /> <br /> <br />Directors of Mid-Continent Enterprises, Inc. your affiant entered <br /> <br /> <br />into negotiations with the Village of Doniphan, Hall County, <br /> <br /> <br />Nebraska, a Municipal Corporation organized and existing under and <br /> <br /> <br />pursuant to the Laws of the State of Nebraska, to sell the <br /> <br /> <br />property described in Exhibit A. Exhibit A is made a part hereof <br /> <br /> <br />by reference. <br /> <br />3. That pursuant to said authorization, your affiant offered <br /> <br /> <br />to sell the property described in Exhibit A to the Vi llage of <br /> <br /> <br />Don i phan, Nebraska for $1,500.00 and the Vi 11 age accepted said <br /> <br />offer. <br /> <br /> <br />4. That throughout the above described transaction, your <br /> <br /> <br />aff i ant and M i d-Cont i nent Ente rp r 1 ses, I nc. had 1 ega 1 ass i stance <br /> <br /> <br />and was aware of its rights pursuant to State and Federal Law. <br /> <br />5. That your affiant by virtue of his position as President <br /> <br />of Mid-Continent Enterprises, Inc. and pursuant to the authority <br /> <br /> <br />granted him by a Resolution of the Board of Directors of ~'id'- <br /> <br /> <br />Continent Enterp,-ises, Inc., hereby waives any public hearings or <br /> <br /> <br />notices required by State or Federal Law that said company 1S <br /> <br />entitled to receive prior to the consummation of this transact1on. <br /> <br />. . <br />
