<br />88- 104344 <br /> <br />3.4 Addresses and Notices. <br /> <br />\. <br /> <br />The names and addresses of Mortgagor (Debtor) and Mortgagee <br />(Secured Party) are as set forth below, and any notice, request, <br />demand or other canmunication permitted or required hereunder <br />shall be in writing and shall be deemed duly given if deposited <br />in the United States mails, reg istered or certified, return <br />receipt requested, postage prepaid, and addressed as follows: <br /> <br />If to Mortgagor: <br /> <br />RJN Management Corporation <br />822 Marquette Avenue <br />Sui te 206 <br />Minneapolis, MN 55402 <br /> <br />If to Mortgagee: <br /> <br />Commercial State Bank in St. Paul <br />2000 Minnesota World Trade Center <br />30 East Seventh Street <br />St. Paul, MN 55101 <br /> <br />or at such other address as either party shall notify the other <br />of as aforesaid. <br /> <br />3.5 Headings. <br /> <br />The headings of the sections contained herein are for <br />convenience only and are not to be construed to be a part of or <br />limit or affect the terms hereof. <br /> <br />3.6 Governing Law; Severability. <br /> <br />This Mortgage shall be governed by the laws of the State of <br />Nebraska. In the event that any provis10n or clause of this <br />Mortgage conflicts with applicable law, such conflict shall not <br />affect other provisions of this Mortgage which can be given <br />effect without the conflicting provisions, and to this end the <br />provisions of the Mortgage are declared to be severable. <br /> <br />3.7 Miscellaneous Rights of Mortgagee. <br /> <br />Mortgagee may at any time and from time to time, without <br />notice, release any person liable for payment of any <br />indebtedness, a~cept additional security of any kind, release any <br />property securing the Indebtedness, consent to the making of any <br />plat or map of the Mortgaged property or the creation of any <br />easement thereon or any covenantsrrestricting use or occupancy <br />thereof, or agree with Mortgagor to alter or amend the terms of <br />this Mortgage in any way. No such release, acceptance, consent <br />or modification shall affect the liability of any person other <br />than the person so released, from payment of any indebtedness <br /> <br />-15- <br /> <br />I I <br />
