The Subdivider agrees to grade the sub- <br />division in conjunction with the structure and parking facilities <br />thereon so that storm water drains to the public right-of-way, <br />subject to the final approval of the City's Director of Public <br />Works. <br /> <br />5. Sidewalks. The Subdivider, if still the owner of the <br />land within the subdivision, or if the Subdivider shall have <br /> <br />transferred title to the property, then the various grantees <br /> <br /> <br />thereof, will install, at their expense, all sidewalks required <br /> <br />by the Grand Island City Code when the adjacent lot is built <br /> <br />upon, such sidewalks to include sidewalks adjacent to State <br /> <br /> <br />Street one foot from the property line, and also a sidewalk to <br /> <br />connect the above sidewalk to the sidewalk located on the <br /> <br />adjacent Block 2, Continental Gardens. <br /> <br />6. Warranty. The undersigned owner, as Subdivider, <br /> <br />warrants that it is the owner in fee simple of the land described <br /> <br />and proposed to be known as REPLAT OF BLOCK ), CONTINENTAL <br />or title insurance policy <br />GARDENS, and that an abstract of titlelWill be submitted for <br /> <br />examination, if necessary, upon request of the City of Grand <br /> <br />Island. <br /> <br />6. This agreement shall run with the land and shall be <br />binding upon and inure to the benefit of the parties hereto, its <br /> <br />successors and assigns. Where the term "Subdivider" is used in <br /> <br />this agr~ment, the subsequent owners of any lots in the sub- <br />division shall be responsible to perform any of the conditions of <br /> <br />3 <br />
