Except as specifically modified by this Loan Modifica- tion Agreement, all other terms and provisions of the Note dated June 24 , '1985, previously executed by the Borrowers shall remain in full force and effect. 3. The Note dated June 24 , 19.1!!io hereby modified is presently secured by a Deed of Trust dated June 24 , 19 85, and recorded as Document No. 85-003085 in the office of the Register of Deeds of Hall County, Nebraska, in respect to that real estate described as: Lot Five (5). in Block Two (2) in Bartling's Subdivision located on part of Lot Fifteen (15), of the County Sub- division of the South Half of the Southeast Quarter (S~i) of Section Sixteen (16) in Township Eleven (11) North. Range Nine (9) and on part of the Northeast Quarter of the Northeast Quarter (NEil-NEt) of Section 'l\ventv One (21) in Township eleven (11) North. Ran!1;e Nine (9) West of the 6th P.M., in the City of Grand Island. Hall Countv. Nebraska. and, in accordance w1th the provisions of that Deed of Trust, it shall remain as security for the indebtedness hereby modified. 4. All real estate mortgages, deeds of trust, assignments and security agreements heretofore granted by Borrowers to the Lender shall remain in full force and effect and shall in no manner be affected by this Loan Modification Agreement and shall continue as security for the indebtedness modified by this Agreement, as well as any future indebtedness owing from Borrowers to the Lender for future '~ances and renewals in respect to all sums owing from Borrowers to the Lender. s. Borrowers further covenant to and with the Lender that they shall, and will, at any time, now or later, upon request, make, do, execute and deliver all such further and other acts, deeds and things as shall be reasonably required to effectuate the intention of this Loan Modification Agreement and to insure and confirm to the Lender all and singular the property, securi- ties and rights described, and intended to be conveyed as security, so as to render the same, and all portions, whether now owned, or later acquired, subject to these terms, provisions and conditions according to the true intent and purposes expressed. 6. The failure of the Lender, at any time, to require the performance by the Borrowers of any of these terms, covenants and agreements shall, in no way, affect its rights to enforce the same: nor the waiver by the Lender of any breach of any term, covenant or agreement be taken or held to be a waiver of any succeeding breach or any such term, covenant or agreement, or as a waiver of the term, covenant and Agreement itself. -2-
