Except as specifically modified by this Loan Modifica- <br />tion Agreement, all other terms and provisions of the Note dated <br />June 24 , '1985, previously executed by the Borrowers shall <br />remain in full force and effect. <br /> <br />3. The Note dated June 24 , 19.1!!io hereby modified is <br />presently secured by a Deed of Trust dated June 24 , 19 85, <br />and recorded as Document No. 85-003085 in the office of the <br />Register of Deeds of Hall County, Nebraska, in respect to that <br />real estate described as: <br /> <br />Lot Five (5). in Block Two (2) in Bartling's Subdivision <br />located on part of Lot Fifteen (15), of the County Sub- <br />division of the South Half of the Southeast Quarter <br />(S~i) of Section Sixteen (16) in Township Eleven (11) <br />North. Range Nine (9) and on part of the Northeast <br />Quarter of the Northeast Quarter (NEil-NEt) of Section <br />'l\ventv One (21) in Township eleven (11) North. Ran!1;e <br />Nine (9) West of the 6th P.M., in the City of Grand <br />Island. Hall Countv. Nebraska. <br /> <br />and, in accordance w1th the provisions of that Deed of Trust, it <br />shall remain as security for the indebtedness hereby modified. <br /> <br />4. All real estate mortgages, deeds of trust, assignments <br />and security agreements heretofore granted by Borrowers to the <br />Lender shall remain in full force and effect and shall in no <br />manner be affected by this Loan Modification Agreement and shall <br />continue as security for the indebtedness modified by this <br />Agreement, as well as any future indebtedness owing from Borrowers <br />to the Lender for future '~ances and renewals in respect to all <br />sums owing from Borrowers to the Lender. <br /> <br />s. Borrowers further covenant to and with the Lender that <br />they shall, and will, at any time, now or later, upon request, <br />make, do, execute and deliver all such further and other acts, <br />deeds and things as shall be reasonably required to effectuate <br />the intention of this Loan Modification Agreement and to insure <br />and confirm to the Lender all and singular the property, securi- <br />ties and rights described, and intended to be conveyed as security, <br />so as to render the same, and all portions, whether now owned, or <br />later acquired, subject to these terms, provisions and conditions <br />according to the true intent and purposes expressed. <br /> <br />6. The failure of the Lender, at any time, to require the <br />performance by the Borrowers of any of these terms, covenants and <br />agreements shall, in no way, affect its rights to enforce the <br />same: nor the waiver by the Lender of any breach of any term, <br />covenant or agreement be taken or held to be a waiver of any <br />succeeding breach or any such term, covenant or agreement, or as <br />a waiver of the term, covenant and Agreement itself. <br /> <br />-2- <br />
