SURVIVORSHIP WARRANTY DEED 88- 104006 LAWRENCE E. NIEMOTH and DARLENE A. NIEMOTH, husband and wife, each in his and her own right and as spouse of the other, herein called the Grantors, in consideration of Ten and No/100 Dollars ($10.00) and other valuable consideration, do grant, bargain, sell, convey and confirm unto LAWRENCE E. NIEMOTH and DARLENE A. NIEMOTH, husband and wife, as joint tenants with right of survivorship and not as tenants in common, herein called the Grantees, the following-described real estate in Hall County, Nebraska: A tract of land comprising a part of the Northwest Quarter (NW1) of Section Twenty-Three (23), Township Twelve (12) North, Range Nine (9) West of the 6th P.M., Hall County, Nebraska, and more particularly described as follows: Beginning at a point on the South line of said NWl; said point being Five Hundred (500.0) feet East of the southwest corner of said NWl; thence running easterly along the South line of said NW1 a distance of Five Hundred Twenty (520.0) feet; thence deflecting left 900 00' and running northerly a distance of six Hundred Fifty (650.0) feet; thence deflecting left 900 00' and running westerly a distance of Five Hundred Twenty (520.0) feet; thence deflecting left 900 00' and running southerly a distance of six Hundred Fifty (650.0) feet to the point of beginning and containing 7.759 acres more or less. TO HAVE AND TO HOLD the above-described premises together with all tenements, hereditaments and appurtenances thereto belonging, unto the Grantees and to their assigns, or to the heirs and assigns of the survivor of them forever. Grantors do hereby covenant with the Grantees that Grantors are lawfully seized of said premises; that they are free from encumbrance; that they are conveyed subject to covenants, conditions, restrictions, reservations and easements of record; that Grantors have good right and lawful authority to convey the same; and that Grantors warrant and will defend the title to said premises against the lawful claims of all persons whomsoever. Grantors also hereby convey to Grantees all of Grantors' right, title and interest in and to a certain easement granted to Grantors pertaining to a portion of the Northwest Quarter (NW1) of Section Twenty-Three (23), Township Twelve (12) North, Range Nine (9) West of the 6th P.M., Hall County, Nebraska, pursuant to the terms and conditions of that Warranty Deed dated June 18, 1975, and recorded in the Office of Hall County Register of Deeds in Book 178 of Deeds Page 494,' It is the intention of all parties hereto that in the event of the death of either of the Grantees, the entire fee simple title to the real estate shall vest in the surviving Grantee.
