<br />SURVIVORSHIP WARRANTY DEED <br /> <br />88- 104006 <br /> <br />LAWRENCE E. NIEMOTH and DARLENE A. NIEMOTH, husband and <br />wife, each in his and her own right and as spouse of the other, <br />herein called the Grantors, in consideration of Ten and No/100 <br />Dollars ($10.00) and other valuable consideration, do grant, <br />bargain, sell, convey and confirm unto LAWRENCE E. NIEMOTH and <br />DARLENE A. NIEMOTH, husband and wife, as joint tenants with right <br />of survivorship and not as tenants in common, herein called the <br />Grantees, the following-described real estate in Hall County, <br />Nebraska: <br /> <br />A tract of land comprising a part of the <br />Northwest Quarter (NW1) of Section <br />Twenty-Three (23), Township Twelve (12) <br />North, Range Nine (9) West of the 6th P.M., <br />Hall County, Nebraska, and more particularly <br />described as follows: Beginning at a point <br />on the South line of said NWl; said point <br />being Five Hundred (500.0) feet East of the <br />southwest corner of said NWl; thence running <br />easterly along the South line of said NW1 a <br />distance of Five Hundred Twenty (520.0) feet; <br />thence deflecting left 900 00' and running <br />northerly a distance of six Hundred Fifty <br />(650.0) feet; thence deflecting left 900 00' <br />and running westerly a distance of Five <br />Hundred Twenty (520.0) feet; thence <br />deflecting left 900 00' and running southerly <br />a distance of six Hundred Fifty (650.0) feet <br />to the point of beginning and containing <br />7.759 acres more or less. <br /> <br /> <br />TO HAVE AND TO HOLD the above-described premises together <br />with all tenements, hereditaments and appurtenances thereto <br />belonging, unto the Grantees and to their assigns, or to the <br />heirs and assigns of the survivor of them forever. <br /> <br />Grantors do hereby covenant with the Grantees that Grantors <br />are lawfully seized of said premises; that they are free from <br />encumbrance; that they are conveyed subject to covenants, <br />conditions, restrictions, reservations and easements of record; <br />that Grantors have good right and lawful authority to convey the <br />same; and that Grantors warrant and will defend the title to said <br />premises against the lawful claims of all persons whomsoever. <br /> <br />Grantors also hereby convey to Grantees all of Grantors' <br />right, title and interest in and to a certain easement granted to <br />Grantors pertaining to a portion of the Northwest Quarter (NW1) <br />of Section Twenty-Three (23), Township Twelve (12) North, Range <br />Nine (9) West of the 6th P.M., Hall County, Nebraska, pursuant to <br />the terms and conditions of that Warranty Deed dated June 18, <br />1975, and recorded in the Office of Hall County Register of Deeds <br />in Book 178 of Deeds Page 494,' <br /> <br />It is the intention of all parties hereto that in the event <br />of the death of either of the Grantees, the entire fee simple <br />title to the real estate shall vest in the surviving Grantee. <br /> <br />Dated n ~ <br /> <br />.~ ~. <br />'U"1?-'Ct E ~ <br />awrence E.
