88_1'103874 ASSIGNMENT OF NOTE AND DEED OF TRUST On February 19, 1985, Douglas A. Davis and Kathryn J. Davis, husband and wife. jointly and severally, made and executed a Note in the amount of $39,000.00 payable with interest at 8% per annum according to the terms of the Note to Roy H. Scheel and Donald R. Scheel, as joint tenants with rights of survivorship and not as tenants in common, the Note being payable in monthly installments including interest and principal. On February 19, 1985, Douglas A. Davis and Kathryn J. Davis, husband and wife, as joint tenants with the right of survivorship, as Trustor. made and executed a Nebraska Deed of Trust in which the Omaha National Bank of Grand Island. Grand Island, Nebraska, was Trustee, Roy H. Scheel and Donald R. Scheel, as joint tenants with right of survivorship and not as tenants in common. were the "Beneficiary." The Nebraska Deed of Trust was filed of record in the Office of the Register of Deeds of Hall County, Nebraska, on February 20. 1985, recorded as Document No. 85-000870. Under the terms of the Nebraska Deed of Trust, the Trustor irrevocably transferred, conveyed and assigned to the Trustee in trust, with power of sale, for the benefit and security of the Beneficiary. the following described real estate situated in Hall County, Nebraska: Part of the Southwast Quarter of the Southwest Quarter (SW 1/4 SW 1/4) of Section Twenty-one (21), Township Eleven (11) North, Range Nine (9), West of the 6th P.M.. Hall County, Nebraska, more particularly described as follows: Commencing at a point Two hundred eighty-three and three-tenths (283.3) feet west of the Southeast corner of the Southwest Quarter of the Southwest Quarter (SW 1/4 SW 1/4) of Section Twenty-one (21), running thence north and in a line parallel with the east boundary line of said Southwest Quarter of the Southwest Quarter (SW 1/4 SW 1/4), a distance of Two hundred forty and seven-tenths (240.7) feet, thence at right angles and in a westerly direction one hundred twenty (120) feet, thence at right angles and in a southerly direction Two hundred forty and seven-tenths (240.7) feet. thence at right angles and in an easterly direction One hundred twenty (120) feet to the place of beginning, subject, however, to the highway right-of- way over the southerly Thirty-three (33) feet thereof. Roy H. Scheel, one of the persons named as the Beneficiary in the Nebraska Deed of Trust. died on June 3, 1988. and Donald R. Scheel, as surviving joint tenant, is the sole owner of the Note and sole beneficiary of the Nebraska Deed of Trust above described.
