<br />88_1'103874 <br /> <br />ASSIGNMENT OF NOTE AND DEED OF TRUST <br /> <br />On February 19, 1985, Douglas A. Davis and Kathryn J. Davis, <br />husband and wife. jointly and severally, made and executed a Note <br />in the amount of $39,000.00 payable with interest at 8% per annum <br />according to the terms of the Note to Roy H. Scheel and Donald R. <br />Scheel, as joint tenants with rights of survivorship and not as <br />tenants in common, the Note being payable in monthly installments <br />including interest and principal. <br /> <br />On February 19, 1985, Douglas A. Davis and Kathryn J. Davis, <br />husband and wife, as joint tenants with the right of <br />survivorship, as Trustor. made and executed a Nebraska Deed of <br />Trust in which the Omaha National Bank of Grand Island. Grand <br />Island, Nebraska, was Trustee, Roy H. Scheel and Donald R. <br />Scheel, as joint tenants with right of survivorship and not as <br />tenants in common. were the "Beneficiary." The Nebraska Deed of <br />Trust was filed of record in the Office of the Register of Deeds <br />of Hall County, Nebraska, on February 20. 1985, recorded as <br />Document No. 85-000870. Under the terms of the Nebraska Deed of <br />Trust, the Trustor irrevocably transferred, conveyed and assigned <br />to the Trustee in trust, with power of sale, for the benefit and <br />security of the Beneficiary. the following described real estate <br />situated in Hall County, Nebraska: <br /> <br />Part of the Southwast Quarter of the Southwest Quarter <br />(SW 1/4 SW 1/4) of Section Twenty-one (21), Township <br />Eleven (11) North, Range Nine (9), West of the 6th <br />P.M.. Hall County, Nebraska, more particularly <br />described as follows: Commencing at a point Two <br />hundred eighty-three and three-tenths (283.3) feet west <br />of the Southeast corner of the Southwest Quarter of the <br />Southwest Quarter (SW 1/4 SW 1/4) of Section Twenty-one <br />(21), running thence north and in a line parallel with <br />the east boundary line of said Southwest Quarter of the <br />Southwest Quarter (SW 1/4 SW 1/4), a distance of Two <br />hundred forty and seven-tenths (240.7) feet, thence at <br />right angles and in a westerly direction one hundred <br />twenty (120) feet, thence at right angles and in a <br />southerly direction Two hundred forty and seven-tenths <br />(240.7) feet. thence at right angles and in an easterly <br />direction One hundred twenty (120) feet to the place of <br />beginning, subject, however, to the highway right-of- <br />way over the southerly Thirty-three (33) feet thereof. <br /> <br />Roy H. Scheel, one of the persons named as the Beneficiary <br />in the Nebraska Deed of Trust. died on June 3, 1988. and Donald <br />R. Scheel, as surviving joint tenant, is the sole owner of the <br />Note and sole beneficiary of the Nebraska Deed of Trust above <br />described. <br />
