<br />88-103873 <br /> <br />ASSIGNMENT OF UNDIVIDED ONE-THIRD INTEREST IN <br />AGREEMENT FOR SALE AND PURCHASE OF REAL ESTATE <br /> <br />On September 3, 1986, Roy H. Scheel and Shirley Scheel, his <br />wife, executed an Agreement for Sale and Purchase of Real Estate <br />for sale of an undivided one-third (1/3) interest owned by Roy H. <br />Scheel in and to the following described real estate situated in <br />Hall County, Nebraska: <br /> <br />The South Half of the Southwest Quarter (S 1/2 SW 1/4) <br />of Section Twenty-six (26) in Township Elevert (11) <br />North. Range Nine (9) West of the 6th P.M. in Hall <br />County, Nebraska, containing 80 Acres, according to the <br />Government survey thereof, but subject to the claim of <br />School District No. 28 to the half acre tract in the <br />Southeast corner of said land as conveyed to said <br />District by Deed from Henry Kruse and Wife, recorded in <br />Book F. Page 247, of the records of said Hall County, <br />and less the tract conveyed by Herman Scheel and Minnie <br />Scheel, Husband and Wife. to the State of Nebraska by <br />Warranty Deed filed of record as Document No. 80-006676 <br />on November 19, 1980. <br /> <br />For making a partial distribution of the residuary assets of <br />the Estate of Roy H. Scheel, Deceased. Donald R. Scheel, Personal <br />Representative of the Estate of Roy H. Scheel, Deceased. Estate <br />No. P88-80 in the County Court of Hall County, Nebraska, <br />ASSIGNOR, assigns. grants and transfers to Donald R. Scheel, <br />residuary devisee under the probated Last Will of Roy H. Scheel, <br />Deceased, ASSIGNEE, an undivided one-third (1/3) interest in and <br />to the above described Agreement for Sale and Purchase of Real <br />Estate, and all right, title and interest of Roy H. Scheel, <br />Deceased, in and to one-third (1/3) of the remaining unpaid <br />balance of purchase price to be paid by the buyers, Robert K. <br />Poland and Judith K. Poland. <br /> <br />ASSIGNOR has determined that ASSIGNEE is the person entitled <br />to distribution of the undivided one-third (1/3) interest of Roy <br />H. Scheel, Deceased. in the Agreement for Sale and Purchase of <br />Real Estate described above. ASSIGNOR covenants with ASSIGNEE <br />that ASSIGNOR has legal power and lawful authority to grant, <br />assign, transfer and release the undivided one-third (1/3) <br />interest in and to the above described Agreement for Sale and <br />Purchase of Real Estate to ASSIGNEE. <br /> <br />Executed June~. 1988. <br /> <br />ESTATE OF ROY H.
