<br />I <br /> <br />88- 103708 <br /> <br />SURVIVORSHIP WARRANTY DEED <br /> <br />THE STATE BANK OF CAIRO, A Corporation organized and existing <br />under the laws of the State of Nebraska, herein called the <br />GRANTOR, in consideration of SEVENTY TWO THOUSAND AND NO/OO <br />DOLLARS ($72,000.00) received from GRANTEES, do grant, bargain, <br />sell, convey and confirm unto WILLIE E. GARRE'l'T, JR. And CATHERINE <br />A. GARRETT, Husband and Wife, as joint tenants with right of <br />survivorship and not as tenants in common, herein called the <br />GRANTEES, the following described real estate in Hamilton County, <br />Nebraska: <br /> <br />A Tract of land comprising a part of the Northwest <br />Quarter (NW!) of Section Thirty Six (36), Township <br />Twelve (12) North, Range Twelve (12) West of th2 6th <br />P.M., Hall County, Nebraska, More Particularly Described <br />as follows: <br /> <br />Beginning at the Northwest corner of said NWl, <br />Section Thirty-six (36) Thence Southerly along the <br />Westerly line of said NWi Section 36, a distance of <br />Three Hundred Eighty-seven (387) Feet; thence Easterly <br />and parallel to the Northerly line of said NW! section <br />36 a distance of One Hundred Forty-eight (148) feet; <br />thence Northerly and parallel to the Westerly line of <br />said NWl Section 36 a distance of Three Hundred <br />eighty-seven (387) feet to a point on the northerly line <br />of said NW! Section 36; thence Westerly along the <br />Northerly line of said NWl Section 36 a distance of One <br />Hundred Forty-eight (148) feet to the place of beginning <br />and containing 1.315 acres more or less. <br /> <br />TO HAVE AND TO HOLD the above-described premises together <br />with all tenements, hereditaments and appurtenances thereto <br />belonging, unto the Grantees and to their assigns, or to the heirs <br />and assigns of the survivor of them forever. <br /> <br />Grantor does hereby covenant with the Grantees that Grantor <br />is lawfully seized of said premises; that it is free from <br />encumbrance; that it is conveyed subject to covenants, conditions, <br />restrictions, reservations and easements of record; that Grantor <br />has good right and lawful authority to convey the same; and that <br />Grantor warrants and will defend the title to said premises <br />against the lawful claims of all persons whomsoever. <br /> <br />It is the intention of all parties hereto that in the event <br />of the death of either of the Grantees, the entire fee simple <br /> <br />~ <br />
