<br />JUt.. 5 1988 <br /> <br />~~- 103704 <br /> <br />ORDINANCE NO. 7458 <br /> <br />'. <br /> <br />An ordinance requiring grading, curbing, guttering, and <br />paving of Boggs Avenue from 11th Avenue to 12th Street; providing <br />fo~ the levy and collection of special taxes and assessments upon <br />the adjacent or abutting properties specially benefited by such <br />improvements; and providing an effective date of this ordinance. <br />WHEREAS, that portion of Boggs Avenue from 11th Avenue to <br />12th Street is unpaved and does not exceed two blocks including <br />intersections, or thirteen hundred twenty-five feet, whichever is <br /> <br /> <br />the lesser; and <br /> <br />WHEREAS, paving said portion of Boggs Avenue will make Boggs <br /> <br />Avenue one continuous paved street. <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF <br /> <br />THE CITY OF GRAND ISLAND, NEBRASKA: <br /> <br />SECTION 1. Pursuant to Chapter 18, Article 20, R.R.S. <br /> <br />Nebraska 1943, that portion of Boggs Avenue from 11th Avenue to <br /> <br />12th Street shall be improved by paving, curbing, guttering, and <br /> <br />all incidental work in connection therewith, to be known as <br /> <br />street improvement No. 1161G, in accordance with plans and <br /> <br />specifications prepared by the Engineer for the City and approved <br /> <br />by the Mayor and Council. <br /> <br />SECTION 2. The improvements shall be made at public cost, <br /> <br />but the cost thereof, excluding intersections, shall be assessed <br /> <br />upon the lots and lands in the district specially benefited <br /> <br />thereby as provided by law. <br /> <br />SECTION 3. The lots and parcels of real estate adjacent to <br /> <br />or abutting upon the portion of said street to be improved are <br /> <br />located within the following boundaries: <br /> <br />Beginning at the junction of the East line of Boggs <br />Avenue and the North line of 11th Avenue, said point <br />also being the Southwest corner of Lot 9, Block 5, <br />Boggs and Hill's Addition; thence proceeding in a <br />southerly direction along an extension of the East line <br />of Boggs Avenue for a distance of 25 feet; thence <br />deflecting right in a westerly direction 25 feet from <br />and parallel to the North line of 11th Avenue for a <br />distance of 50 feet; thence deflecting right in a <br />northerly direction along an extension of the West line <br />of Boggs Avenue for a distance ~f 25 feet; thence <br /> <br />~PROV~~O"M <br />JUN 1 ~ 1ge5 <br /> <br />LEGAL DEPARTMENT <br />
