<br />SPECIAL WARRANTY DEED
<br />
<br />DAVID H. SCHUMACHER and YVONNE M. SCHUMACHER, husband
<br />and wife, each in their own right and as spouse of the other,
<br />herein called the Grantors, for and in consideration of
<br />cancellation of personal liability owing from Grantors to
<br />Grantee, do grant, bargain, sell, convey and confirm unto HOME
<br />FEDERAL SAVINGS AND LOAN ASSOCIATION OF GRAND ISLAND, herein
<br />called the Grantee, the fOllowing-described real estate in Hall
<br />County, Nebraska:
<br />
<br />Lots One Hundred Seventeen (117) and one Hundred
<br />Eighteen (118) in West Lawn, an Addition to the
<br />City of Grand Island, Hall County, Nebraska;
<br />
<br />TO HAVE AND TO HOLD the premises above-described,
<br />together with all the tenements, hereditaments and appurtenances
<br />thereunto belonging, unto the said Grantee and to Grantee's
<br />successors and assigns forever. And Grantors hereby covenant
<br />with the said Grantee and with Grantee's successors and assigns,
<br />that Grantors are lawfully seized of said premises, that they are
<br />free from encumbrance, except those of record, and that Grantors
<br />have good right and lawful authority to sell the same; and
<br />Grantors hereby covenant to warrant and defend the title to said
<br />premises against the lawful claims of all persons whomsoever.
<br />And the said Grantors hereby relinquish all right, title, claim
<br />and interest in and to the above-described premises.
<br />
<br />This Special Warranty Deed is given as an absolute
<br />conveyance, the Grantors having conveyed said land to the Grantee
<br />for a fair and adequate consideration, such consideration being a
<br />release of personal liability on obligations secured by the
<br />Mortgage executed by Grantors to Grantee as mortgagee, recorded
<br />as Document No. 79-003723 in the office of the Register of Deeds
<br />of Hall County, Nebraska.
<br />
<br />Grantors declare that this conveyance is freely and
<br />fairly made, and it is the intention of the Grantors and the
<br />Grantee that title herein to be conveyed, in exchange for the
<br />release of personal liability as to the Mortgage, shall not
<br />merge.
