<br />88- 103604 <br />CONSENT 'l'O BUILDDlG A RESIDENTIAL <br />SWIIIIIIIfG POOL <br /> <br />The parties hereto are the owners of Lots One (1) and Two <br />(2) in Regency Country Club Villa Subdivision, which is a <br />subdividing of, Lot Four (4) in Regency By The Green Subdivision, <br />all in the City of Grand Island, Nebraska. <br />Margaret B. McGrath and her husband, Charles Dean McGrath, <br />are the owners of Lot One (1) of said Regency Country Club Villa <br />Subdivision, under a Contract to purchase said Lot One (1) and in <br />which Contract James S. Reed and Precious Reed are the Vendors of <br />said Lot One (1). Alan R. Brisnehan and Patricia J, Brisnehan, <br />husband and wife as joint tenants, are the owners of Lot Two (2) <br />of Regency Country Club Villa Subdivision. <br />Under date of August 2, 1984, a DECLARATION pertaining to <br />said Lots One (1) and Two (2), Regency Country Club Villa <br />Subdivision was filed of record in the Office of the Register of <br />Deeds of Hall County, Nebraska, as Document No. 84-004571. <br />Margaret B. McGrath and her husband, Charles Dean McGrath, <br />as owners of said Lot One (1) are desirous of building a <br />residential swimming pool on a portion of said Lot One (1) and to <br />be located generally to the East of the dwelling structure on <br />said Lot One (1). Pursuant to the requirements of said <br />DECLARATION, permission for the erection and building of such <br />swimming pool and related appurtenances is hereby granted by the <br />said Alan R. Brisnehan and Patricia J. Brisnehan. The owners of <br />said Lot One (1) shall comply in all respects with local and <br />State regulations governing residential swimming pools~ that such <br />pool shall be of a nature, kind, shape, height, material and <br />exterior color scheme as to exist in harmony with the design of <br />the abutting residential structure. The owners of Lot One (1) <br />agree to pay all taxes levied upon or attributable to the <br />swimming pool and agree to pay that portion of any insurance <br />premium attributable to said swimming pool, and in addition, to <br />hold harmless the owners of said Lot Two (2) from any liability <br />in respect to injury suffered by any person at such pool. Such <br />swimming pool and appurtenances will be exclusively owned by <br />Margaret B. McGrath and her husband, Charles Dean McGrath, and <br />they will have the sole use, benefit and obligations pertaining <br />to such sWimming pool for themselves, their invitees, and the <br />successor owners of said Lot One (1). <br />This modification for and consent to the DECLARATION shall <br />be binding upon the owners of said Lots One (1) and Two (2), and <br />their respective heirs-at-law, personal representatives, devisees <br />and assigns, and shall run with the land. <br />DATED this 1o~h day of June, 1988, <br />
