<br />MORTGAGE ADDENDUM <br /> <br />alS- 103557 <br /> <br />The following are addenda to the Mortgage. Please check the applicable adden- <br />dum. The addendum checked shall be incorporated into, and recorded with, the <br />Mortgage. The term "Mortgage" shall be deemed to include "Deed of Trust", if <br />applicable. <br /> <br />xx <br /> <br />FHA ADDENDUM <br /> <br />As long as the Mortgag~ is outstanding, the Lender may Jeclare all sums secured <br />by the Mortgage to be immediately due and payable if: <br /> <br />(a) all or part of the property is sold or otherwise transferred <br />(other than by devise, descent or operation of law) by <br />Borrower to a purchaser or other transferee; <br /> <br />(i) who cannot reasonably be expected to occupy the <br />property as a principal residence within a reason- <br />able time after the sale or transfer. all as <br />provided in Section 143(c) and 143 (i)(2) of the <br />Internal Revenue Code of 1986, as amended; or <br /> <br />(11) who bas had a present ownership interest in a <br />principal residence durjng any part of the three- <br />year period ending on the date of the sale or <br />transfer, all as provided in Section 143(d) and <br />143(i)(2) of the Internal Revenue Codei or <br /> <br />(lii) at an acquisition cost which is greater than 90% <br />of the average area purchase price (greater than <br />110% for targeted area residences). all as provid- <br />ed in Section 143(e) and 143(i)(2) of the Internal <br />Revenue Code; or <br /> <br />(iv) who has an income in excess of that established by <br />the Nebraska Investment Finance Authority under <br />its applicable regulations or program guidelines <br />in effect on the date of the sale or transfer; or <br /> <br />(b) Borrower fails to occupy the property described in the <br />Mortgage without Lender's prior written consenti or <br /> <br />(c) Borrower omits or misrepresents a material fact in an <br />application for the Mortgage. <br /> <br />References are to the Internal Revenue Code in effect on tbe date of execution <br />of the Hortgage and are deemed to include the implementing regulations. <br /> <br />VA MORTGAGE ADDENDUM <br /> <br />If, so long as the Mortgage is outstanding. all or any part of the property is <br />sold or transferred by Borrower without Lender's prior written consent, other <br />than a transfer by devise. descent or by operation of law. the Lender may, at <br />Lender's option, declare all the sums secured by the Mortgage to be immediately <br />due and payable. <br /> <br />Date: <br /> <br />July J, 1988 <br /> <br />-::J ~ t.
