<br />88~ <br /> <br />103356 <br /> <br />LICENSE AGRE~MENT <br /> <br />This License Agreement is made by and between the CITY OF <br />GRA~D ISLAND, NEBRASKA, a Municipal Corporatiq~, herein referred <br />to as the "City" and GREGORY D. CHINGREN and PEGGY A. CH INGREN , <br />husband wife, hereinafter referred to as the "Licensees". <br /> <br />1. STATEMENT OF PURPOSE. The purpose of this License <br />Agreement is to set forth the terms and conditions under which <br />the Licensees may construct, maintain, repair, and utilize the <br />fallowing described improvement which will infringe upon real <br />estate awned or controlled by the City: <br /> <br />-- <br /> <br />A 1.4 foot by twenty-two foot (1.4' x 22') encroach-.nt <br />of a garage located at 821 West Louise Street, <br />Brand Island, Hall County, Nebraska. <br /> <br />2. DESCRIPTION OF LICENSEES' REAL ESTATE. The Licensees <br />own or control the following described real estate adjacent to <br />the City's real estate to which this License Agreement shall apply. <br /> <br />The West One-Half (W-1/2) of Lot Three (3) and <br />all of Lot Four (4), Block Three (3), Wiebe"s <br />Addition to the City of Grand ISland, Hall County, <br />Nebraska. <br /> <br />3. LICENSEES" DUTIES AND RISKS. It is understood and <br />agreed that the Licensees may construct, maintain, repair and <br />utilize the above described improvement at the Licens.... sale <br />risk. The Licensees hereby waive any claim far damages against <br />the City, its officers, employees, agents and independant <br />contractors for any damage or injury that may result to .aid <br />improvement. If the City, in its sole discretion, d.t~.ines <br />that any part or all of the improvement must be r-.aved or is <br />damaged by the City, its employees, agents, or independent <br />contractors working for the City during the course of their <br />eaployment or duties with the City, the Licensees agr.. to assu.. <br />and pay all costs relating to the replacement or repair of the <br />improvement. <br /> <br />4. EFFECTIVE DATE. This license agr....nt shall take <br />effect on the date it is executed by the "ayor of the CitYDf <br />Grand Island as dated below.
