NELSON AND WANDA G. NELSON, Husband acd Wife, hereinafter referred to as "Second Partieslt, !' WITNESSETH: "~EREAS, First Party is owner in fee simple of~ Lot Forty-eight (48). Buenavista Subdivision i~ the City Grand Island. Hall County. Nebraska; and. h~EREAS. Second Parties are owners in fee simple 0;' Lot Forty-nine (49), Butmnvista Subdh'ision in the Citr Grand Island, Hall County, Nebraska; and, WHEREAS, there now exists and for sometime prior hereto h3s existed. a garage. partially located and encroaching on the west boundary line of the property of the Second Parties. which is more particularly described in the attached Exhibit 'A'. and by this reference made a part of the easement; NOW, THEREFORE, in consideration of the premises herein, it is mutually agreed nnd understood that Second Parties grants to First Party. an eA5ement far the continuing tlse and location of said garage located on the real p.stRte duscribed herein and more particularly set forth in ExhiT,it 'A'; IT IS FURTHER MUTUALLY AGREED AND UNDERSTOOD that the rights and privileges herein created are to run with the land and shall be bindin~ ~n the part~os hereto. their heirs and assigns, unless teminated by la\l or mutual agr.ement. It is further understood and agreed that this easement shall cease .nd terminate upon the raze. removal and destruction of the garage and that First Party and their assigns shall at all times during the existence of this easement. be responsible for the maintenance and repair of said garage.
