<br />I <br /> <br />88- 10:J733 <br /> <br />Directors shall have the power to enforce these restrictive <br />covenants. By acceptance of ti tIe, an owner agrees to <br />voluntarily pay the sum determined as an annual assessment. <br />In the event of failure or refusal of any lot owner to pay <br />the assessment, the Board of Directors shall have authority <br />to bring an action for the collection of one or more annual <br />assessments and the other consents to judgment for said sum <br />to the end that said amount, costs and a reasonable <br />attorneys fee shall become a lien against the lot. Memoers <br />of the Board of Directors shall serve without compensation. <br /> <br />12. These covenants, restrictions and conditions are <br />to run with the land and shall be binding on all persons and <br />all parties claiming ownership of said lots until January 1, <br />2008, at which time said covenants, etc., shall be <br />automatically extended for successive periods of ten (10) <br />years, unless changed, or modified by a vote of a majority <br />of the then owners of the lots in said subdivision. <br /> <br />~., <br /> <br />, <br />~ <br />f <br />~ <br />~ <br />~. <br /> <br />13. If any owner of any lot, or their heirs or assigns, <br />shall violate or attempt to violate any of the covenants, <br />restrictions and conditions herein set forth, it shall be <br />lawful for any other person or persons owning any real <br />estate in said addition to prosecute such proceedings at law <br />or in equity against the person or persons violating or <br />attempting to violate any such covenants, etc., and to <br />prevent him from so doing or to recover damages for such <br />violations. <br /> <br />K~ <br /> <br />1 4.
