<br />88- 102566 <br /> <br />STATE OF NEBRASKA <br />COUNTY OF HALL <br /> <br />55. <br /> <br />AFFIDAVIT TO CLEAR <br />TITLE ON DEATH OF <br />LULA E. KIMBALL <br /> <br />WAYNE A. KIMBALL, being first duly sworn on his oath, <br />deposes and says: <br /> <br />1. He resides at 258 South Kimball Avenue, Grand. Island, <br />Hall County, Nebraska, and is the surviving spouse of Lula E. <br />Kimball, who died testate on the 17th day of May, 1988. She, <br />too, resided at the above address at the time of her death. <br /> <br />2. No proceedings for probate of the Will of Lula E. <br />Kimball nor for administration of her estate is pending, and none <br />is contemplated. The sole heirs-at-law of Lula E. Kimball are <br />the following: Wayne A. Kimball, this Affiant and her surviving <br />husband; Betty Lohmann, daughter; Dale Kimball, son; and the two <br />children of a predeceased son of Lula E. Kimball, and such <br />surviving grandchildren of Lula E. Kimball and their names being <br />Stacy Kimball Raymie and Sue Kimball Solvig. <br /> <br />3. The Decedent was the owner of no separately-owned <br />property. The only property in which the Decedent had an in- <br />terest at the time of her death was property owned by her in <br />joint tenancy with this Affiant, her surviving spouse, Wayne A. <br />Kimball. Such jointly-owned property included the following: <br /> <br />An undivided one-half interest in the North Half of the <br />Northwest Quarter (N!NWi) and the West Half of the <br />Northeast Quarter (W!NEi) in Section Thirteen (13), <br />Township Twelve (12) North, Range Nine (9), West of the <br />6th P.M., in Hall County, Nebraska, excepting for <br />tracts previously conveyed therefrom; <br /> <br />AND <br /> <br />The Northerly Forty (40) Feet of Lot Eleven (11), in <br />Block Two (2), Axt & Hagge's Addition to the City of <br />Grand Island, Hall County, Nebraska. <br /> <br />4. There is no Federal Estate Tax nor Nebraska Estate Tax <br />nor Nebraska Inheritance Tax owing herein inasmuch as all taxable <br />assets passed to the Decedent's spouse, this Affiant, and the <br />same are thereby exempt from any such death taxes. The total <br />value of taxable assets for Federal Estate Tax purposes does not <br />equal nor exceed $600,000, and no Federal Estate Tax Return will <br />be filed. <br /> <br />Dated this 18th day of May, 1988. <br /> <br />':..'/'/Jt_./.:":)_.,~:< J-:;:~ / ,.,!
