<br />which is hereby acknowledged, hereby grants and conveys unto the
<br />
<br />CITY OF GRAND ISLAND, NEBRASKA,
<br />
<br />a Municipal corporation in Hall County, Nebraska, herein called the Grantee, a
<br />
<br />permanent and perpetual easement and right-of-way to survey. construct,
<br />
<br />inspect, maintain, repair, replace, extend, remove, and operate thereon,
<br />
<br />overhead and underground utilities, including but not Itmited to: electric
<br />
<br />lines, cables, poles, watermains, pipelines, and all appurtenances connected
<br />
<br />therewith, in, upon, above, along, across, underneath, and through a tract of
<br />
<br />land located in Lot One (I), Platte Valley Indust~ial Park Subdivision. in the
<br />
<br />City of Grand Island, Hall County, Nebraska; the easement tract being more
<br />
<br />particularly described as follows:
<br />
<br />The Westerly sixteen (16.0) feet of Lot One (I), Platte
<br />Valley Industrial Park Subdivision, and
<br />
<br />A sixteen (16.0) foot wide tract of land, the centerline
<br />being more particularly described as follows: Commencing
<br />at the Southwest corner of said Lot One (I), Platte Valley
<br />Industrial Park Subdivision; thence Northerly along the
<br />Westerly line of said Lot One (I), a distance of two
<br />hundred thirty (230.0) feet, to the actual point of
<br />beginning; thence Easterly, perpendicular to said Westerly
<br />line of Lot One (1), a distance of one hundred twenty four
<br />(124.0) feet.

<br />The above-described tracts of land, containing a combined
<br />total of 0.242 acres more or less, as shown on the plat
<br />dated 4/27/88, marked Exhibit "A", attached hereto, and
<br />incorporated herein by reference,
<br />
<br />together with all rights of ingress and egress for installation and maintenance
<br />
<br />of such overhead and underground utility lines and appurtenances,
<br />
<br />Such rights of ingress and egress shall include all rights necessary for
<br />
<br />the full and complete use, occupation, and enjoyment of the easement herein
<br />
<br />granted, including but not limited to: the right to excavate and refill
<br />
<br />ditches and trenches; to remove trees, bushes, hedges, undergrowth, and other
<br />
<br />obstructions interfering with the location, construction, inspection, repair,
<br />
<br />replacement, removal, and maintenance of such overhead and underground utility
<br />
<br />lines.

<br />The parties hereto agree that the Grantor may continue to use the easement
<br />
<br />area herein granted for any use permitted by law. that does not interfere with
<br />
<br />the operation and maintenance of the overhead and underground utility lines and
<br />
