The Licensee's application for a pennit to <br />alter said improvement or any part thereof, unless said <br />permi t is for work due to an occurrence as descr"ibed <br />in Paragraph 3 above Qnd said work has the prior <br />written approval of the City. <br /> <br />Upon the termination of this License Agreement, the Licensee <br />shall be required, and hereby agrees, to remove said improvement <br />from the City's real estate at its own expense and without cost <br />to the City. Said removal to concur no later than sixty days <br />after receipt of the notice of intention to terminate or any of <br />the other occurrences set forth in Paragraph 5 above. Should the <br />Licensee fail to do so, the City may remove or cause the removal <br />of said improvement from the City's real estate and the Licensee <br />agrees to reimburse the City for all its costs. <br /> <br />b. SUCCESSORS AND ASSIGNS. This agreement shall be binding <br />upon the parties hereto, their successors and assigns. <br /> <br />7. ENTIRE AGREEMENT. This License Agreement constitutes <br />the entire agreement between the parties notwithstanding any <br />other oral or written agreements to the contrary. This License <br />Agreement shall be amended only in writing executed by all <br />parties hereto. <br /> <br />8. CHOICE OF LAWS. This License Agreement shall be <br />construed in accordance with the laws of the State of Nebraska <br />and the City of Grand Island, Nebraska. <br /> <br />9. CONTEXT OF LANGUAGE. Wherever the context of the <br />language in this License Agreem~nt is appropriate, the singular <br />shall apply to the plural and the plural shall apply to the <br />singular. <br /> <br />10. MISCELLANEOUS CONDITIONS. The Licensee shall be <br />responsible for all maintenance, including snow removal, <br />patching, shoulder maintenance, ditch maintenance and traffic <br />control devices in connection with the above described <br />improvements. In the event the City of Grand Island assumes <br />control of the portion of Woodland Drive subject to this license <br />agreement, the above sign shall either be removed or a new <br />application for a license pgreement submitted by the Licensee. <br />ThR sign shall be located at least ten (10') feet north of the <br />paved surface of Woodland Drive to permit adequate visibility ior <br />tr.ffic on Woodland Drive and any service drives extending north. <br /> <br />,. <br /> <br />.. <br /> <br /> <br />L <br /> <br />~ <br /> <br />L <br />
