<br />r- <br /> <br />88- <br /> <br />102054 <br /> <br />RELEASE OF CITY FOR LOSS OF ACCESS <br /> <br />KNOW ALL MEN BY THESE PRESEMTS, that Equitable Building and Loan, <br />hereinafter called "Grantor", of Hall County, Nebraska, for and in considera- <br />tion of the sum of $6,025.00, to Grantor in hand paid by the City of Grand <br />Island, Nebraska, a municipal corporation, and Grantee herein, the receipt <br />and sufficiency of which is hereby acknowledged, does hereby release, <br />relinquish and discharge the City of Grand Island, Nebraska, from any damages <br />whatsoever that may be claimed or asserted by or through Grantor, Grantor's <br />successors or assigns, for the loss of vehicular access to 16th Street from <br />Grantor's abutting property as a result of or in connection with the City's <br />restriction of vehicular traffic to that portion of 16th Street located <br />between Webb Road and Piper Street, Grantor's abutting property more <br />particularly described on Exhibit "A" attached hereto and incorpo~::{ted <br />herein ~y reference. <br /> <br /> <br />It is the intent of the undersigned herein that this instrument shall <br />operate as a total and complete release of the City of Grand Island, Nebraska, <br />for any and all damages, special or general, which may be suffered by the <br />said Grantor, its successors, and assigns, as a result of the restriction of <br />the aforementioned portion of 16th Street to vehicular traffic and Grantor's <br />associated loss of access to any and all of Grantor's abutting property in <br />connection therewith; and in this regard, Grantor, its successors and <br />assigns are hereby barred forever from asserting any such claim for damages, <br />or from filing any court action seeking damages or any form of injunctive <br />relief, or from any other remedy available to Grantor in law or equity, all <br />of which said remedies or forms of relief Grantor specifically herein waives, <br />releases, and relinquishes. <br /> <br />Executed this 27th day of <br /> <br />July <br /> <br />, 1983. <br /> <br />TH~ EQUITABLE BUILDING AND LOAN ASS'N <br /> <br />4i~{;f'/ <br />~l:?- .'.~'7-<!:~} <br />Grantors R 17 K' n oct t <br />. !'. 1nman,. t'eS1 en <br /> <br />CITY OF GRAND ISLAND.
