<br />KNOW ALL MEN BY THESE PRESENTS, THAT:
<br />
<br />WHEREAS. in an action in the District Court of Hall County,
<br />Nebraska wherein. Norwest Bank Nebraska. N.A. flkla First Savings
<br />Company, a federal banking institution, is Plaintiff, and Edward S.
<br />Cummings, Mary Beth Cummings, John R. Fenderson, Josnn M. Fendersonn
<br />and Omaha National Bank nlkla Firstier Bank, N.A.. are Defendants, on
<br />January 4, 1988, Plaintiff did obtain a Decree finding that there is
<br />from Edward S. Cumming and Mary Beth Cummings to Norwest Bank
<br />Nebraska, N.A. flkla First Savings Company, a federal banking institu-
<br />tion the sum of $7,788.28 with interest continuing to accrue at the
<br />rate of 12.39 percent per annum, and costs of suit; and
<br />
<br />
<br />WHEREAS, it was further ordered in said Decree that in
<br />default of the payment of the sums so found due by the said Edward S.
<br />Cummings and Mary Beth Cummings, that the appointed Master
<br />Commissioner should cause the lands and tenements hereafter described
<br />to be advertised .and sold according to law to pay the SBme; and
<br />
<br />WHEREAS, defaul t baving been made therein, the said Master
<br />Commissioner, Roger G. Steele. in Hall County, Nebraska, under and by
<br />virtue of said Decree and the Order of Sale to him duly directed, did
<br />on March 7, 1988 at the Hall County Courthouse in the City of Grand
<br />Island in said County of Hall, having first given due and legal notice
<br />of the time and place of said sale by publication once in each week
<br />for five consecutive weeks in a newspaper printed and in general cir-
<br />culation in said Hall County, sell said premises at public auction to
<br />Norwest Bank Nebraska, N .A. f/k/a First Savings Company, a federal
<br />banking institution, its successors and 8ssigns, for the sum of Nine
<br />-Thousand Dollars ($9,000.00), which sale was afterward on l>tarch 28,
<br />1988 examined and confirmed, and the said Roger G. Steele as such
<br />Master Commissioner, ordered to convey said premises in fee simple
<br />title to the purchaser, to-wit: Norwest Bank Nebraska, N.A., its
<br />successors and assigns.

<br />NOW, THEREFORE, I, Roger G. Steele. Master Commissioner in
<br />the County of Hall, as aforesaid, in consideration of the premises and
<br />by virtue of the powers vested in me by law and the decree of said
<br />Court. do hereby give J grant and convey to Norwest Bank Nebraska,
<br />N .A.. its successors and assigns, the premises sold as aforesaid,
<br />to-wit:

<br />Easterly One-Third (E1/3) of Lot Three (3), in Block
<br />Eighty-one (81), Original Town of Grand Island, Hall
<br />County, Nebraska
<br />
<br />to have and to hold th~ same unto Norwest Banle. Nebraska, N.A., its
<br />successors and assigns, and to them and their use and behoof forever.
