NEUBERT, husband and wife, each in their own right and as spouse of the other, herein called the Grantors, for and in consideration of the cancellation of indebtedness owing from Grantors to Grantee, do grant, bargainf sell, convey and confirm unto HO}-IE FEDERAL SAVINGS AND LOAN ASSOCIATION OF GRAND ISLAND, herein Cil lled the Grantee, the following-described real estate in Hall County, Nebraska: Lots One (1), T\vo (2) and 'rhree (3) of Neubert Subdivision, formerly known as Lot Twenty (20), Bosselman's Second Subdivision, in the City of Grapd Island, Hall County, Nebraska; TO HAVE AND TO HOLD the premises above-described, together with all the tenements, hereditaments and appurtenances thereunto belonging, unto the said Grantee and to Grantee's successors and assigns forever. And Grantors hereby covenant with the said Grantee and with Grantee's successors and assigns, that Grantors are lawfully seized of said premises, that they are free from encumbrance and that Grantors have good right and lawful authori ty to sell the same; and Grantors hereby covenant to warrant and defend the title to said premises against the lawful claims of all persons whomsoever. And the said Grantors hereby relinquish all right, title, claim and interest in and to the above-described premises. This special Warranty Deed is given as an absolute conveyance, the Grantors having conveyed said land to the Grantee for a fair and adequate consideration, such consideration being satisfaction of principal obligations secured by the Mortgages executed by Grantors to Grantee as mortgagee recorded as Document No. 78-006997, Document No. 79-003840, and Document No. 79-003841 in the office of the Register of Deeds of Hall County, Nebraska. Grantors declare that this conveyance is freely and fairly made, and it is the intention of the Grantors and the Grantee that title herein to be conveyed in exchange for the release of personal liability as to the mortgages shall not merge.
