<br />thereof as aforesaid, shall not cure or woive any default or notice of defoull hereunder or invalidate ony act done pursuanl to such notice.

<br />5. Upon defoult by 'frustor in the paymenl of ony indebtedness secured hereby or in the performance of ony agreement contained herein,
<br />all sumB secured hereby shall immediately become due and payable at tIll' option of the Beneficiary. In sllch event and upon written request
<br />of Beneficiary, Trustee sholl sell the trust property. in occordanc", with the Nebrnsko 'frust Deeds Act, at public auction to the highest
<br />bidder, Any person except Trustee may bid Ilt 'frllstee's sole. Trnstee shall "pply the proceeds of the sole as follows: (1) to the expense
<br />of the sale, including a reasonable Trustee's fee; (2) to the oblil(ation secufed by this Decd of'frust; 131 the surplus, irany, shall be distributed

<br />the property which Trustor had or had the power to convey at the time of his execution of this Deed of 'frust, and such as he may have
<br />acquired thereafter. Trustee'a deed shall recite the facts showin!: thot till' sale was conducted in compliance with all the requirements
<br />of law and of this Deed of 1'rust, which recital shall be prima facie evidence of such compliance and conclusive evidence thereof in favor
<br />of bono /ide purchasers and encumbrancers for value.

<br />8. In the event of the death, incapacity, disability or resignation of 'frustee. Beneficia..y may appoint in writing a successor trustee,
<br />and upon the recording of such appointment in the mortgoge records of the county in which this Deed of 'frust is recorded, the successor
<br />trustee shall be vesled with all powers of the original trustee, 'fhe trustee is not obliged to notify any party hereto of pending sale under
<br />any other Deed of Trust or of any action or proceeding in which 'frustor, Trustee or Beneficiary shall be 0 party uoless such aclion or
<br />proceeding is brought by the 'frustee,

<br />9. This Deed of 'frust applies to, inures to the benefit of, and is binding not onl)' on the parties hereto, but on their heirs. devisees,
<br />legatees, administrators, executols, successors and assigns. 'fhe term Beneliciary shall mean the holder and owner of the nole secured
<br />hereby, whether or nol named as Beneficiar)' herein.
