<br />I <br /> <br />88-101526 <br /> <br />SUBORDINATION OF RENTAL PROPERTY REHABILITATION LIEN <br /> <br />KNOW ALL MEN BY THESE PRESENTS, that: <br /> <br />WHEREAS, RICHARD J. STREHLE and THEODORE C. MOLCZYK, herein- <br />after referred to as "Debtors", did on the 18th day of June, <br />1986, execute and deliver to the City of Grand Island a Rental <br />Property Rehabilitation Lien upon certain real estate located in <br />Hall County, Nebraska, and legally described as: <br /> <br />The Easterly One-Third (E 1/3) of Lot six (6) <br />and all of Lot Seven (7) in Block Eighty-Three <br />(83) in original Town Addition to the City of <br />Grand Island, Hall County, Nebraska; <br /> <br />conditioned for and to secure the payment of the sum of six <br />Thousand One Hundred Fifty and No/100 Dollars ($6,150.00) in <br />accordance with the rules and procedures of the Rental and <br />Rehabilitation Program of the city of Grand Island, Nebraska, <br />which Rental Property Rehabilitation Lien was recorded in the <br />Office of the Hall County Register of Deeds as Document No. <br />86-103565; and <br /> <br />WHEREAS, Debtors, for the purpose of securing the indebted- <br />ness for funds to be advanced, have agreed tc execute and deliver <br />a Deed of Trust upon the real estate to Horne Federal Savings and <br />Loan Association of Grand Island conditioned upon the payment of <br />the sum of Forty Thousand and No/IOO Dollars ($40,000.00), to be <br />a first Deed of Trust lien upon the real estate; <br /> <br />NOW, THEREFORE, in consideration of monies to be advanced to <br />the Debtors and as an inducement therefor, the City of Grand <br />Island, by and through its duly authorized representative and in <br />accordance with Paragraph 12 of the Rental Property Rehabilitation <br />Lien, does hereby bargain, consent, promise and agree that in <br />respect to the real estate above described its lien shall at all <br />times be secondary and subordinate to the Deed of Trust wherein <br />Home Federal Savings and Loan Association of Grand Island is to <br />be identifiā¬1 as the Beneficiary, it being the intention of the <br />City of Grand Island that at all times the lien of Home Federal <br />savings and Loan Association of Grand Island shall constitute a <br />first lien on the real estate. <br /> <br />This agreement shall continue and remain in full force and <br />effect until Horne Federal savings and Loan Association of Grand <br />Island has been paid in full on account of all claims, demands, <br />indebtedness, actions, or causes of action of any nature whatso- <br />ever which it may now or hereafter have against the Debtors on <br />account of its lien in respect to the real estate above described. <br /> <br />-1- <br /> <br />L <br /> <br />--1 <br /> <br />L <br />
