<br />I <br /> <br />88- <br /> <br />101461 <br /> <br />LICENSE AGREEMENT <br />(MERRICK - CITY OF GRAND ISLAND) <br /> <br />J <br /> <br />This License Agreement is made by and between the CITY OF <br />GRAND ISLAND, NEBRASKA, a Municipal Corporation, herein referred <br />to as the "City" and RICHARD J. MERRICK and LINDA J. MERRICK, <br />husband and wife, hereinafter referred to as the "Licensees." <br /> <br />1. STATEMENT OF PURPOSE. The purpose of this- License <br />Agreement is to set forth the terms and conditions under which <br />the Licensees may construct, maintain, repair, and utilize the <br />following-described improvements which infringe upon real estate <br />sUbject to a utility easement in favor of the City: <br /> <br />(a) A storage shed located on a utility <br />easement as shown on Exhibit "A" <br />attached hereto and made a part hereof <br />by reference. <br /> <br />(b) A pool, concrete apron, concrete drive, <br />and fence located on a utility easement <br />as shown on Exhibit "A" attached hereto <br />and made a part hereof by reference. <br /> <br />2. DESCRIPTION OF LICENSEES' REAL ESTATE. The Licensees <br />own the following-described real estate on which the City 's <br />utility easement is located and to which this License Agreement <br />shall apply: <br /> <br />Lot Eleven (11) and a tract of land <br />comprising a part of Lot Twelve (12), Block <br />Three (3) of Rep1at of Riverside Acres, an <br />Addition to the City of Grand Island, Hall <br />County, Nebraska, and more particularly <br />described as follows: Beginning at a point <br />on the west line of said Lot ~~elve (12), <br />said point being One Hundred Fifty (150.0) <br />feet North of the Southwest corner of said <br />Lot Twelve (12), thence running North along <br />the West side of said Lot Twelve (12) a <br />distance of One Hundred Eighty-Three and <br />Three Tenths (183.3) feet to the Northwest <br />corner of said Lot 'l'welve (12); thence <br />running southeasterly along the arc of a One <br />Hundred Twenty (120.0) feet radius curve a <br />distance of Ninety and Thirty-Four Hundredths <br />(90.34) feet; thence running southwesterly to <br />the point of beginning. <br /> <br />3. LICENSEES' DUTIES AND RISKS. It is understood and <br />agreed that the L~censees may construct, maintain, repair and <br />utilize the above-described improvements at the Licensees' sole <br />risk.
