<br />GRANT <br /> <br />88-101378 <br /> <br />In consideration of the payment of TEN AND XX/lOa DOLLARS <br />($10.00) and other good and valuable consideration, the receipt <br />of which is hereby acknowledged, PETERSEN FARMS, INC. (Grantor) <br />does hereby ~rant and convey unto AT&T Communications of the <br />Midwest, Inc., and its associated and allied companies (defined <br />to include American Telephone and Telegraph Company, its parent <br />and its subsidiaries) a right of way and easement to construct, <br />operate, maintain, replace and remove an underground fiber <br />optic cable system consisting oE a single cable and associated <br />appurtenances (inCluding conduit, casings, warning tapes, <br />manholes, splicing boxes and markers) upon, across and under a <br />strip of land 16.5 feet wide, described as set forth on Exhibit <br />I, across the Grantor's land being Lot 2 of the Wilson's <br />Subdivision of a part of Section Three (3), Township Eleven <br />(11) North, Range Nine (9) West of the 6th P.M. in Hall County, <br />Nebraska, together with the following rights: rights of ingress <br />and egress to, from, and along lands adjacent to said strip for <br />the purpose of constructing and maintaining said communications <br />system (including specifically for construction purposes a <br />temporary easement 50 feet wide, being 25 feet on either side <br />of the path of the cable); the right to place above-ground <br />markers at fence lines, property lines and ditch banks; the <br />right to clear and keep cleared all trees, roots, brush and <br />other obstructions from the surface and subsurface of said <br />strip and during construction to cut all trees within 10 feet <br />thereof; and the right to install gates in any fences crossing <br />said strip. <br /> <br />The Grantor, for itself and its successo~s and assigns hereby <br />covenants that no structure shall be erected or permitted on <br />said strip, but reserves the right to cross said strip with <br />roads, driveways, field tile and other utilities including <br />water, electricity, gas and sewer lines and to continue <br />ordinary cultivation of said strip. <br /> <br />The rights herein granted shall revert to the Grantors if the <br />Grantees abandon the easement area for a period of ten (10) <br />consecutive years. <br /> <br />Signed and sealed this ~5 ~ day of <br />at Grand Island, Nebraska. <br /> <br />..;.~x.;: ~ '.
