This mortgage shall become void, and the <br />mortgagor entitled to a release in recordable form upon full <br />Payment of the note owed to the Five Points Bank, referred to <br />herein, including any accrued interest, penalties or other <br />expenses associated therewith. <br />3. DEFAULT. If default shall be made, on any payment owed <br />by mortgagor to the Five Points Bank, so as to invoke the <br />guarantee of mortgagee herein, then, at the option of the <br />mortgagee, he shall institute an action in foreclosure to <br />foreclose this mortgage. <br />4.
