Baack ("Trustee") and HOME FEDERAL SAVINGS AND LOAN ASSOCIATION OF GRAND ISLAND ("Beneficiary"), covering the following described property: Lot Ten (10), having. a lake front footage of 54 feet, situated on the West Side of the West Portion of Kuester Lake and being on a part of the E~SW! in Section 13, Township 11, Range 9, in Hall County, Nebraska, bounded on the Northwesterly Side by a common road; such lot is as shown on a plat in the possession of the Lessor. "This mortgage is given to secure a chattel promissory note the security for which is all personal and chattel property located upon said lot, and all of our interest and ownership in the common stock of Kuester Lake, Inc." hereby acknowledge that it is understood that (a) the Deed of Trust to be executed by Trustor is a trust deed and not a mortgage and (b) the power of sale provided for in the Deed of Trust provides substantially different rights and obligations to the Trustor than a mortgage in the p.vent of a default or breach of obligation.
