<br />AGREEMENT FOR RESCISSION OF PROTECTIVE
<br />COVENfu~TS, RESTRICTIONS AND CONDITIONS
<br />FOR PART OF THE LOTS IN OLDE MILL SUBDIVISION,
<br />CITY OF GRAND ISLAND, HALL COUNTY, NEBRASKA
<br />
<br />WHEREAS, the undersigned Mid-America Co., a Nebraska corporation,
<br />is the owner of fifty (50) lots within Olde !'1ill Subdivision, City
<br />of Grand Island, Hall County, Nebraska, described as follows:
<br />
<br />
<br />Lots One (1) through Seventeen (17), both inclusive,
<br />in Block One (1); Lots One (1) through Twenty-Six
<br />(26), both inclusive, in Block Two (2); Lots One (1)
<br />through Six (6), both inclusive, in Block Three (3);
<br />and Lot Two (2) in Block Four (4), and
<br />
<br />
<br />WHEREAS, such fifty (50) lots owned by the undersigned
<br />constitutes a majority of the total of ninety-eight (98) lots
<br />in said Olde Mill Subdivision, and
<br />
<br />
<br />WHEREAS, paragraph 12 of the Agreements for Protective
<br />Covenants, Restrictions and Conditions for said Olde Mill Sub-
<br />division, City of Grand Island, Hall County, Nebraska, as recorded
<br />at document #78-002204 in the office of the Register of Deeds of
<br />Hall County, Nebraska, provides that such covenants are to run
<br />with the land and shall be binding upon all parties and all persons
<br />claiming under them for a period of ten (10) years from the date
<br />hereof, at which time said covenants shall be automatically extended
<br />for successive periods of ten (10) years each unless by vote of a
<br />majority of the then owners of lots in said subdivision it is
<br />agreed to change said covenants in whole or in part, and
<br />
<br />WHEREAS, such Agreements for Protective Covenants, Restrictions
<br />and Conditions for Olde Mill Subdivision, City of Grand Island, Hall
<br />County, Nebraska, are dated April 13, 1978, and
<br />
<br />WHEREAS, it is the desire of the undersigned Mid-America Co.
<br />to change said covenants by rescinding such covenants as they
<br />pertain to Lots One (1) through Seventeen (17), both inclusive,
<br />of Block One (1) and Lots One (1) through Twenty-Six (26), both
<br />inclusive, of Block Two (2) in said Old Mill Subdivision so that
<br />they are of no further force and effect after ten (10) years from
<br />April 13, 1978,

<br />NOW, THEREFORE, the undersigned, being the owner of a majority
<br />of the lots in said Olde Mill Subdivision hereby votes, stipulates
<br />and agrees that the Protective Covenants, Restrictions and Conditions
<br />for Olde Mill Subdivision, City of Grand Island, Hall County,
<br />Nebraska, as recorded as document #78-002204 in the office of the
<br />Register of Deeds of Hall County, Nebraska, shall be rescinded in
<br />their entirety and of no further force and effect from and after
<br />April 13, 1988, as pertains to Lots One (1) through Seventeen (17),
<br />both inclusive, in Block One (1) and Lots One (1) through Twenty-
<br />Six (26), both inclusive, in Block Two (2) in said Olde Mill
<br />Subdivision, a subdivision in the City of Grand Island, Hall County,
<br />Nebraska.
