<br />Nebraska Public Power District (hereinafter called "District"), its (their) lessees, successors end assigns, the permanent right, privilege, and easement of right..
<br />of.way ro construct, operate, maintain, inspect, repair, remove, alter, relocate and reconstruct its electric transmission lines, including all necessary palea,
<br />wires, guys and other equipment used in connection therewith, along a route describe~ herei~. The centerline !lethe electr!c transmission line, shall be established
<br />by the acluallocation o!the electric transmission line as originally constructed on sood prem.see. The approxrmate location and route ofthe subject transmission
<br />line is described as follows:

<br />Five (5) poles and one (1) anchor placed along the centerline of the electric transmission line to be located
<br />over, under, upon, and across a portion of a parcel of land located in the SE~ of the NE~ of Section 31,
<br />Township 12 North, Range 10 West of the 6th P.M., Hall County, Nebraska. Said parcel of 1a~d is described in
<br />Deed, recorded on microfilm, Document No. 78-008179 in the Hall County Register of Deeds Off1ce. Said electric
<br />transmission line is shown on the plat identified as Exhibit "A" attach':ld hereto and incorporated herein.
<br />
<br />The District shall, wherever reasonably poasible, utilize public right-of-way to survey, construct, maintain, inspect, remove, alter, relocate or reconstruct the
<br />District's electric transmission lines or any associated equipment.
<br />
<br />The districlshall also have the right at any time ro trim or remove such t"""" and underbrush as may in any way endanger or interfere with the safe construction,
<br />operation, maintenance, alteration or reconstruction of its transmission lines and equipment used in connection therewith, including but not limited ro topping
<br />or removing any trees which in falling would come within fifteen (15) feet of the nearest electric line conductor. All refuse from BUch tree cutting or timming shall
<br />be burned or removed by the District, and the District shall have the right to control by chemicals all weeds, trees, and brush along, adjacent to and under the
<br />electric transmission line if said right of way is not being utilized for cultivated crops.
<br />
<br />The District agrees ro pay the Granror or Lessee, as their interests may appear, for any damage ro personal property, fences,livestock, and to growing crops
<br />caused by the survey and original construction of said line. Final paymentshall be made on or before 60 days after completion of the construction stated herein.
<br />
<br />The District agrees ro pay the Grenror or Lessee, as their interests may appear, for any damage to personal property, fences, livestock, and ro growing crops
<br />occutring after the initial construction and resulting from the survey, operation, maintenance, inspection, repair, removal, alteration, relocation and recon.
<br />struction of the District's electric transmission lines. It is further agreed that all claims for such damages must be submitted to the District in writing within
<br />90 days of such occurrence; otherwise, it is agreed that said claim for damages shall have been waived.
<br />
<br />The District agrees ro take all reasonable steps ro resrore, as nearly as possible to the condition it was in prior ro construction, all land which is damaged as a
<br />.eoult of said construction.
<br />
<br />The Granror may cultivate, use, and enjoy the land along and adjacent ro the electric transmission line provided that such use shall not endanger or be a hazard
<br />ro or interfere with the survey, construction, reconstruction, repair, maintenance, insp""tion, operation, alteration, relocation and removal of the District's
<br />electric transmiuion lines. No buildings, structures, hay or straw stacks shall be permitted underneath or immediately adjacent ro the electric transmission line
<br />except by express written permiasion from the District.
<br />
<br />The District agrees that should eaid right-of-way not be used for the purposes herein stated, or should allY transmission line constructed hereunder be removed
<br />and not replaced by another transmission line, for a period of five years, the right-of-way and easement hereby secured shall then cease and tenninate, and this
<br />instrument shall be of no furth.... force and effect.
<br />
<br />The undersigned agrees and represents that he has read and understands the foregoing and that thio instrument contains all agreements and understandings
<br />between the parties and the undersigned haa not relied upon any promises, inducements, covenants, oral statements, or agreements of any kind or nature which
<br />are not expressly set forth herein.
