<br />I <br /> <br />PREFACE TO NEBRASKA TIWST DEED <br />(to be filed for record as a part of the Trust Deed) <br /> <br />ACKNOWLEDC E~lENT <br /> <br />88- 100935 <br /> <br />I/We, Midland Ag Service, Inc., a Nebraska Corporation <br />Trustor (whether one or more) under that certain T~ust Deed dated <br />:0 be entered into among Trustor. The Farmers Nationa1 Bank of r.pn~ral <br />City ,Trustee, and The Farmers ~ational Bank of Central City <br />\Lender, covering the following described property: <br /> <br />The Northwest Quarter of the Northeast Quarter <br />(NW1/4NE1/4) and the North Half of the Northwest <br />Quarter(Nl/2NW1/4) of Section Thirty-Five (35), <br />in Township Ten (10) North, Range Eleven (11) <br />weGt of the 6th P.M., Hall County, Nebraska, <br /> <br />hereby acknowledge that Trustor understands that (a) the Nebraska Trust Deed to <br />be executed by Trustor is a trust deed and not a mortgage and (b) the power <br />of sale provided for in the Trust Deed provides substantially different <br />rights snd obligations to the Trustor than a mortgage in the event of a default <br />ur bresch of obligation. <br /> <br />HOMESTEAD DISCLAIMER/WAIVER (LB )) <br /> <br />Trustor hereby additionally states: <br />( X) That no part of his or her homestead is presently or in the future <br />will be situated upon the real estate described in the Trust <br />Deed and that he or she understands that if he or she establishes <br />a homestead on any part of the real estate during the time the <br />Trust Deed remains unsatisfied and a lien upon the real estate, <br />there shall be no right to make a designation of homestead in <br />the event of a foreclosure or ~ruBteels sale upon such Trust Deed. <br /> <br />That he or she understands that he or she has the right to make <br />a designation of homestead in the Trust Deed and the execution <br />hereof constitutes the waiver of rights otherwise available for <br />the purpose of affording the Trustor the opportunity to retain <br />his of her homestead in the event of a default upon said Trust Deed. <br />V <br /> <br />Trustor acknowledges that this Acknowledgement and Homestead Disclaimer/ <br />Waiver was made prior to the execution of the Trust Deed. <br /> <br />Executed and delivered this <br /> <br />l'?th day of <br /> <br />FE'b:'uiJrV <br /> <br />19 38 <br /> <br />Midland Ag Service, Inc. <br />'IY"u-s-nn- <br /> <br />/2~ ~ X.~ (,~_-t'--t!~ <br />Trustor <br />Roger L.
