<br />KNOW ALL MEN BY THESE PRESENTS: THAT we, EDWARD F. DOMALAKES, JR. AND CAROL ANN
<br />DOMALAKES, of the county of Hall, State of Nebraska, have agreed to give up and
<br />surrender the lands hereinafter described in lieu of a foreclosure, as security for
<br />the amount of money remaining unpaid on said mortgage, do hereby sell and convey unto
<br />FIRST FEDERAL SAVINGS AND LOAN ASSOCIATION OF LINCOLN, a United States Corporation,
<br />its successors and assigns, for and consideration of the sum of One and No/IOO Dollar
<br />($1.00), and other valuable consideration, the following described premises, to-wit:

<br />Fractional Lot Nine (9), in Fractional Block Three (3), Gilbert's
<br />Second Addition to the City of Grand Island, Hall County,
<br />Nebraska.
<br />
<br />together with all appurtenances thereunto belonging, free and clear of all
<br />encumbrances except a first mortgage in favor of First Federal Savings and Loan
<br />AssociRtion of Lincoln, Lincoln, Nebraska, in the principal sum of Thirty-eight
<br />Thousand Two Hundred Fifty and No/lOO Dollars ($38,250.00), dated October 31, 1979 and
<br />filed for record October 31, 1979 in Document No. 79-007190, of the Mortgage Records
<br />of Hall County, Nebraska, and easements and restrictions of record, and do covenant to
<br />warrant and defend the said premises against any act of said grantors or any other
<br />person claiming through or under it. The grantee hereby releases and discharges any
<br />and all liens and claims under and by virtue of the mortgage aforesaid for a
<br />deficiency judgment. The grantors further covenant that this conveyance is anfl does
<br />constitute an absolute conveyance of title to the premises to the grantee herein in
<br />effect as well as form, and is not intended as a mortgage, trust conveyance or as
<br />security of any kind and that possession of the premises is delivered concurrently
<br />herewith. And the said grantors hereby relinquish all right, title, interest and all
<br />equity of redemption in and to the above described premises.
