Allen and Donna Jean Allen, husband and wife, <br /> <br />being first duly sworn, depose and say as follows: <br /> <br />1 . That they are the identical parties who entered <br /> <br />into a contract for the sale of real estate between <br /> <br />themselves and Harlan K. Johnson and Frances Johnson on the <br /> <br />1st day of December, 1981, conveying the following described <br /> <br />property: <br /> <br />Lot Five (5), in Block Thirty-nine (39), in Russel <br />Wheeler's Addition to the City of Grand Island, <br />Hall County, Nebraska. <br /> <br />2. That Affiants now are and at all times herein <br /> <br />mentioned have been husband and wife. <br /> <br />3. That in the execution of the contract of sale and <br /> <br />documents required thereunder, Affiants were not acting <br /> <br />under any misapprehension as to the effect thereof and acted <br /> <br />freely and voluntarily and were not acting under coercion or <br /> <br />duress. <br /> <br />4. That consideration of the contract and receiving <br /> <br />the Deed thereunder was the payment of the purchase price of <br /> <br />Forty-three Thousand, Five Hundred Dollars ($43,500.00). <br /> <br />That the Purchasers hereunder are in default and that in <br /> <br />settlement of the contract and in further consideration of <br /> <br />Sellers forbearance to sue or otherwise foreclose the <br /> <br />contract, the Purchasers have agreed to convey their <br /> <br />,..-.-.. <br /> <br />L, <br /> <br />L <br /> <br />-.J <br /> <br />r' <br />
