88u= 100548 AGREEMENT BETWEEN CO-OWNERS FOR MAINTENANCE AND REPAIR OF COMMON EASEMENT THIS AGREEMENT made th~~ay of January, 1988, between RANDALL S. r MENDYK and CAROL R. MEtIDYK, Husband and Wife, of 904 North Wheeler, Grand Island, Nebraska, and IRENE SCHROEDER. an unremarried widow, of 912 North Wheeler, Grand Island, Nebraska, WITNESSETH: WHEREAS, the parties hereto are co-owners of an Easement in the nature of a common garage located upon the property legally described as the South 74.8' feet of Lot Ten (10), Block Sixteen (16), in Russel Wheeler's Addition currently owned by Randall S. Mendyk and Carol R. Mendyk, Husband and Wife, and the property legally described as the North 57.2 feet of Lot Ten (10), Block Sixteen (16), Russel Wheeler's Addition currently owned by Irene Schroeder, an unremarried widow, as more fully shown on the attached Plot Plan hereby made a part of this Agreement; NOW, THEREFORE, the parties hereto agree to share, on an equal basis, all costs of repair and maintenance necessary to maintain the common garage in as good a condition as the same exists on the date of this Agreement. The parties further agree that in the event the structure is damaged or destroyed to such as extent that repair or replacement would be equal to or exceed fifty percent (50%) of the value of the property on the date of it's I I I ! j I 1 J i i i damage or destruction, the parties are hereby relieved of any further obligation to each other for the repair or replacement of the structure. The parties further agree to indemnify the other against all liability for injury to himself or damage to his property when such injury or damage shall result from, arise out of, or be attributable to any maintenance or repair undertaken pursuant to this Agreement.
