<br />JOHN ~ SPOTANSKI and DELORES A. SPOTANSKI, Husband and Wife, herein
<br />called Grantors, in consideration of 0 U E.. D C~~
<br />receipt of which is hereby acknowledged, hereby grants and conveys unto the
<br />
<br />CITY OF GRAND ISLAND, NEBRASKA,
<br />
<br />a municipal corporation in Hall County, Nebraska, herein called Grantee, a
<br />permanent and perpetual easement and right-of-way to survey, construct,
<br />inspect, maintain, repair, replace, extend, remove, and operate thereon,
<br />overhead electrical utility lines, poles, anchors, terminals, transformers,
<br />cables, conductors, surface markers, and other appurtenances connected
<br />therewith, in, upon, above, along, across, over, and through a sixteen (16.0)
<br />foot wide tract of land for easement purposes, located in part of the East Half
<br />of the Southeast Quarter of the Southwest Quarter (E-l/2,SE-l/4,SW-l/4), of
<br />Section Twenty Three (23), Township Eleven (11) North, Range Nine (9), West of
<br />the 6th P.M., Hall County, Nebraska; being more particularly described as
<br />follows:

<br />The Westerly sixteen (16.0) feet of the Southerly five
<br />hundred (500.0) feet of the East Half of the Southeast
<br />Quarter of the Southwest Quarter (E-1/2,SE-l/4,SW-1/4) of
<br />Section Twenty Three (23). Township Eleven (11) North.
<br />Range Nine (9) Wast.
<br />
<br />The above described tract of land containing 0.184 acres
<br />more or less. as shown on the plat dated 1/25/88. marked
<br />Exhibit "A", attached hereto, and incorporated herein by
<br />reference,
<br />
<br />together with the following rights:
<br />
<br />Unrestricted ingress and egress to the above described easement tract for
<br />the installation, maintenance, operation. and removal of such overhead
<br />electrical utility lines and appurtenances.
<br />
<br />Such rights of ingress and egress shall include all rights necessary for
<br />the full and complete use, occupation, and enjoyment of the easement herein
<br />granted, including but not limited to the right. to place electrical line
<br />anchors, or anchors with guy wires attached thereto, on Grantors' property; to
<br />remove, clear. and keep clear trees, bushes, hedges, undergrowth, and other
<br />obstructions interfering with the surveying, construction. inspection,
<br />maintenance, repair, replacement, extension. removal, or operation of such
<br />overhead electrical utility lines and appurtenances. No structures, buildings,
<br />fences, or other obstructions of any kind whatsoever, shall be allowed in.
<br />upon. above. along, across, over, or through the easement herein granted.

<br />The parties hereto agree that the Grantors may continue to use the
<br />easement area herein granted for any other use permitted by law, that does not
<br />interfere with the operation and maintenance of the overhead electrical utility
<br />lines and appurtenances constructed therein.
<br />
<br />All overhead electrical utility lines, poles. anchors. terminals,
<br />transformers. cables, conductors, surface markers. and other appurtenances
<br />
