ROSS, husband and wife, each in <br />his and her own right and as spouse of ~ other, herein called <br />G7tors, in con,sideratign of t6A.J~' :..-L-~~f ~/...r LJd4..~ <br />ZU'J k~ ././uJ~ 1fto S? ~'" 00 , receipt of wh' ch is hereby <br />acknowredge ,hereby gra and convey unto the <br /> <br />CITY OF GRAND ISLAND, NEBRASKA, <br /> <br />a municipal corporation in Hall County, Nebraska, herein called <br />the Grantee, a permanent and perpetual easement and right-of-way <br />to construct, operate, maintain, extend, repair, replace, and <br />remove public utilities, including but not limited to, sanitary <br />sewers, pipelines, surface markers, and other appurtenances <br />necessary for the operation and maintenance upon, in, above, and <br />through a tract of land located in the Southwest Quarter of the <br />Northeast Quarter (SW l/4 NE 1/4) of Section ~~o (2), Township <br />Eleven (11) North, Range Ten (10) West of the 6th P.M., Hall <br />County, Nebraska, more particularly described as follows: <br /> <br />Beginning at the Northwest corner of Lot Thirteen (13) <br />of the Ross-Heights Second subdivision; thence running <br />northerly along the East right-of-way line of <br />Independence Avenue for a distance of four hundred <br />twenty-four (424) feet; thence running easterly along a <br />line four hundred twenty-four (424) feet North of and <br />parallel to the North line of said subdivision for a <br />distance of eight (8) feet; thence running southerly <br />along a line eight (8) feet East of and parallel to the <br />East right-of-way line of Independence Avenue for a <br />distance of four hundred sixteen (4l6) feet; thence <br />running easterly along a line eight (8) feet North of <br />and parallel to the North line of the Ross Heights <br />Second Subdivision for a distance of five hundred <br />fifty-seven (557) feet; thence running southerly for a <br />distance of eight (8) feet to the Northeast corner of <br />Lot Nine (9) of the Ross Heights Second Subdivision; <br />thence running westerly along the North line of Ross <br />Heights Second Subdivision for a distance of five <br />hundred sixty-five (565) feet to the point of <br />beginning, said tract containing 7,848 square feet <br />(0.108 acre), more or less, all as shown on the plat <br />marked Exhibit "A" attached hereto and incorporated <br />herein by reference; <br /> <br /> <br />together with the following rights, namely, unrestricted ingress <br />and egress under and across such land for the purpose of <br />exercising the rights herein granted, to clear and keep clear of <br />trees, roots, brush, and other obstructions from the surface of <br />such tract.
